RESOLUTION 2000-074
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING FOR DISPOSAL BY SALE, LOT 2, BLOCK 3,
FOURTH OF JULY CREEK SUBDMSION, SEWARD MARINE INDUS-
TRIAL CENTER FOR NO LESS THAN mE APPRAISED FAIR MARKET
VALUE OF $81,664
WHEREAS, Dan Lowry ofDalo Marine has offered to purchase Lot 2, Block 3, Fourth of
July Creek Subdivision, Seward Marine Industrial Center from the City of Seward for its appraised
value; and
WHEREAS, the requested parcel is located east of Nash Road between Jellison Avenue and
Mustang. Avenue within the Seward Marine Industrial Center, and is zoned Industrial; and
WHEREAS, pursuant to Seward City Code ~ 7.05.120, the City Council may dispose of real
property by negotiation, public auction or sealed bid.
NOW, mEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Seward Marine Industrial Center (SMIC) has been identified and marketed
as available for disposal by long term lease. The City has long sought business development in SMIC
and finds it in the public's interest make this particular parcel available for purchase to further such
development. The City Council finds it in the public interest to dispose of Lot 2, Block 3, Fourth of
July Creek Subdivision, SMIC, through sole source negotiations with Dan Lowry and/or Dalo Marine
or a related entity, for industrial/business development purposes. The sale shall be for no less than
the fair market value of $81,664, subject to terms and conditions to be negotiated and brought before
the City Council for final consideration and approval.
Section 2. The City recently completed an appraisal ofa 43,605 square foot portion of Lot
2, Block 3, Fourth ofJuly Creek Subdivision, SMIC, for the purpose of determining the fair market
rental value of the City's pending Lease No. 99-116 to Dan Lowry d.b.a. DALCO Corp. The City
finds that it is in the public interest to conduct the negotiations described in this resolution without
completing another City appraisal of the property. The City hereby accepts the fair market valuation
of$.75 per square foot, as determined by MacSwain Associates recent appraisal ofa 43,605 square
foot portion of Lot 2, Block 3, Fourth ofJuly Creek Subdivision, SMIC, for the purpose of sat is tying
the appraisal requirement and to identity the fair market land value of Lot 2, Block 3, Fourth ofJuly
Creek Subdivision at $81,664.

Section 3. The City Manager is authorized and directed to negotiate a real estate purchase
and sale agreement with Dan Lowry, and/or Dalo Marine or a related entity, with such agreement to
be brought back to the City Council for the City Council's further consideration and final approval.
Section 4. It is not intended that this resolution approve the proposed described real estate
transaction but is to authorize the negotiation of such a purchase and sale agreement. Any
subsequent resolution actually approving the real estate transaction shall not take effect until 30 days
after passage and posting as required by Seward City Code ~ 7.05.140.
Section 5. Negotiations will be completed within forty-five days of passage of this
Resolution.
Section 6. This resolution shall take effect immediately.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 24th day
of July, 2000.
