HomeMy WebLinkAboutRes2000-076 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2000-076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A NEW LEASE AGREEMENT WITH JAMES T. PRUITT FOR A PORTION OF TRACT A, NORTH HARBOR SUBDIVISION, SEWARD RECORDING DISTRICT, THIRD JUDICIAL DISTRICT, STATE OF ALASKA, FOR THE PURPOSES OF OPERATING A GASOLINE STATION AND RETAIL MERCHANDISE FACILITY WHEREAS, James T. Pruitt (Lessee) has proposed a lease term extension to his existing lease agreement, Lease Number RE-84-043 with the City of Seward for a portion of Tract A, North Harbor Subdivision, Seward Recording District, Third Judicial District, State of Alaska, for the purposes of operating a gasoline station and retail merchandise facility; and WHEREAS, the current lease has been iIi effect since May 1, 1984 and the Lessee has established a gasoline station and retail merchandise facility on the leased land; and WHEREAS, the Lessee has recently completed extensive capital improvements to the leased property and desires to take advantage of improved fmancing arrangements and can only do so by extension of his lease term; and WHEREAS, the City desires to update the form and content of the old lease and bring the lease up to date by terminating Lease Number RE-84-043 and entering into a new lease agreement with Lessee using current forms, terms and conditions in conjunction with the lease term extension; and WHEREAS, the City is currently platting certain City property including the leased land and will include on such plat certain easements, rights-of-way, and the like affecting the leased land and adjoining property; and WHEREAS, it is in the public interest to promote continued and increased retail activity of this type within the City and benefit the community through stability, job growth and other related economic impacts; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION 2000-076 Section 1. It is the public's interest to enter into a new lease agreement for the leased land with James T. Pruitt for the reasons stated in the above recitals which are incorporated herein by reference. Section 2. The City Manager is hereby authorized to enter into a new lease agreement with James T. Pruitt, attached and incorporated herein by reference, in substantial form as attached hereto, and to r~cord a lease memorandum to reflect such lease terms, and to make such changes to the attached lease as necessary to finalize the lease between the parties but without changing the substantive terms as described in the attached lease. Section 3. Lease Number RE-84-043 shall not be terminated and the new lease shall not be signed or become effective until the leased land is first surveyed and a plat filed to reflect the current lease site dimensions and existing or reasonably necessary easements, rights-of-way, and the like. The plat to be filed and all notations thereon, shall be subject to approval at the sole discretion of the City through the City Manager. Section 4. This resolution shall take effect thirty (30) days after its adoption and posting. PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 24 day of July, 2000.
