<br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2000-085 <br /> <br />Section 2. The City Manager is also authorized to finalize and execute such additional <br />documents necessary to the franchise agreement and agree to revisions to the documents so long as <br />the essential terms of the franchise agreement are not substantially changed. <br /> <br />Section 3. For the reasons stated herein and the recitals ofthis Resolution which are hereby <br />incorporated by reference as written findings of the City Council, it is determined that pursuant to <br />Seward City Code Section 96.10.130, the public interest would best be served by not requiring <br />competitive proposals from other potential service providers prior to approving the franchise <br />agreement described herein. The current franchisee has demonstrated its ability to provide quality <br />service to the community at a reasonable price. There is a public benefit in providing uninterrupted <br />garbage and refuse collection and disposal services within the community. The franchisee has the <br />equipment and personnel available to continue to provide local service. The percentage of fees <br />received by the City for administrative costs will adequately compensate the City. The City Council <br />will also retain rate approval as provided in the City Charter and Code. <br /> <br />Section 4. At the regular municipal election to be held on October 3, 2000, the City shall <br />submit to the qualified voters of the City the question of approval of the franchise agreement noted <br />above. An affirmative vote ofa majority of the qualified electors voting on the proposition shall be <br />required for approval of the franchise agreement. <br /> <br />Section 5. The proposition shall be substantially in the following form: <br /> <br />Proposition No'. <br />Franchise agreement for the collection and <br />disposal of garbage and refuse. <br /> <br />Do you approve a five-year franchise agreement with Peninsula <br />Sanitation Company Inc., a division of Waste Management, Inc. for <br />the collection and disposal of garbage and refuse? The franchise <br />agreement would contain an option to extend for an additional five <br />years and would provide for an annual rate review with consumer <br />rates to be set by resolution of the City Council. <br /> <br />Section 6. The above proposition shall be printed on a ballot which may set forth other <br />propositions. The proposition set forth in Section 5 above shall be printed in full, and the <br />following words shall be added as appropriate and next to a space provide for marking the ballots: <br /> <br />Proposition No. <br />Yes <br />No <br />
