HomeMy WebLinkAboutRes2000-086 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2000-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, NOMINATING AND AUTHORIZING FOR DISPOSAL, BY LEASE THROUGH NEGOTIATION, A PORTION OF PUBLIC LAND DESCRIBED AS THE SOUTH 10' PORTION OF NORTH HARBOR PARKING LOT, TRACT A, BLOCK 1, NORTH HARBOR SUBDIVISION, WHICH SUCH 10' STRIP OF LAND IS IMMEDIATELY ADJACENT TO THE LEASE SITE DESCRIBED IN RESOLUTION 2000-076 AND AP- PROVED FOR LEASE TO JAMES T. PRUITT FOR THE PURPOSE OF OPERATING A GASOLINE STATION AND MERCHANDISE FACILITY WHEREAS, James T. Pruitt has requested that the north boundary of his existing lease (Lease 84-043) with the City of Seward be extended twenty-five (25) feet north to increase the delivery area available and to improve safety considerations for the fuel tankers and the other supply trucks; and WHEREAS, the requested public land is described as the south twenty-five (25) foot portion of the North Harbor Parking Lot, Tract A, Block 1, North Harbor Subdivision; and WHEREAS, the requested area has not previously been designated as available for lease; and WHEREAS, in accordance with the City's Lease Policies and Procedures established by Resolution 94-101, the Council, at its May 8, 2000 meeting, forwarded the request to the Planning and Zoning Commission for review and recommendation; and WHEREAS, the Planning and Zoning Commission reviewed the request at its July 11, 2000 meeting, and failed to approve a motion recommending the disposal of 10 feet of the North Harbor Parking Lot to James Pruitt for expansion of hi's existing Lease 84-043; and WHEREAS, notwithstanding the failure of the Planning and Zoning Commission to recommend the disposal ofa strip ofland 10 feet in width along the south boundary of the North Harbor Parking Lot, the City Council finds it to be in the public interest to make sch parcel ofland available for disposal to resolve public safety concerns and provide for additional space for fuel delivery and other supply vehicles at the adjacent lease site; and WHEREAS, pursuant to Seward City Code ~ 7.05.120, the City Council may dispose of real property. by negotiation, public auction or sealed bid. CITY OF SEWARD, ALASKA RESOLUTION 2000-086 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. For the reasons set forth herein, and the above recitals, the City Council finds it in the public interest to dispose by long-term lease, a strip ofland ten (10) feet in width located along the south boundary of the North Harbor Parking Lot, Tract A, Block 1, North Harbor Subdivision, in order to mitigate existing safety concerns associated with the adjacent property currently leased to James T. Pruitt by Lease 84-043. The disposal method is to be through sole source negotiation with James T. Pruitt by amending the long-term lease authorized by Resolution 2000-076, subject to negotiations by the City Manager and final approval by the City Council at a later date. Section 2. The City Council finds that it is in the public interest to negotiate the lease amendment described in this resolution without completing a City appraisal because an appraisal of the adjacent City leased property was completed in March, 2000 by MacSwain Associates in order to determine the fair market value of the land, and the lease site as amended will be reappraised in five years for lease rate adjustment purposes. Section 3. The City Manager is authorized to negotiate on behalf of the City, an amendment to the long-term lease authorized by Resolution 2000-076 with James T. Pruitt, for the purpose of expanding the lease site to include a strip of land ten (10) feet in width located along the south boundary of the North Harbor Parking Lot, Tract A, Block 1, North Harbor Subdivision, subject to further consideration and final approval by the City Council at a later date. This resolution shall not be considered the final approval of a real estate transaction or approval of the actual lease amendment. It is intended the City Manager will negotiate the terms of the lease amendment for the City Council's subsequent consideration and approval and that any subsequent resolution to approve such an agreement not take effect until 30 days after passage and posting as required by Seward City Code ~7.05.140.
