HomeMy WebLinkAboutRes2000-093 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2000-093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN AMENDMENT TO THE RULES, RATES, CHARGES AND REGULATIONS FOR PORT AND HARBOR FACILITIES FOR THE CITY OF SEWARD, ALASKA WHEREAS, a proposal has been made for the construction or reconstruction of capital improvements within the Seward Small Boat Harbor (the "improvements") and for the City to borrow money and issue its revenue bonds for the purpose of financing the costs of the improvements; and WHEREAS, vessels using the City's docks and small boat harbor facilities impact the harbor facilities and operations throughout the small boat harbor, primarily vessels carrying passengers for hire, by large numbers of people traveling on the ramps, docks, and walkways to board vessels; and WHEREAS, the estimated cost of the improvements is not to exceed $3,000,000 which would be paid through the issuance of revenue bonds by the City; and WHEREAS, in order to retire the bonds authorized to provide amounts to pay for the improvements, the City would, among other things, agree to collect passenger fees in an amount sufficient to pay expenses and debt service on the revenue bonds; and WHEREAS, it is the intent of the City Council to collect only those passenger fees sufficient to pay expenses and debt service on the revenue bonds and for other capital improvements in the Seward Small Boat Harbor; and WHEREAS, it is the intent of the City Council to not adopt new passenger fees while the revenue bonds are outstanding, and the passenger fees provided for in this resolution shall sunset on payment of the revenue bonds; and WHEREAS, the existing port and harbor tariff regulations providing for rules, rates, charges and regulations for port and harbor facilities for the City of Seward, Alaska, must be amended to impose a passenger fee in order to provide the funds to pay expenses and debt service on the revenue bonds and for other capital improvements in the Seward Small Boat Harbor; and WHEREAS, pursuant to Seward City Code Section 7.10.610, the City Council shall set, by resolution, the rates for use of all harbor facilities. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION NO. 2000-093 Section 1. The City Council finds that the costs of maintenance of the small boat harbor are increasing as a direct result of increases in use of harbor facilities by vessels carrying passengers for hire and funds are necessary to cover the improvements of the small boat harbor facilities. Section 2. Subsection 230(a) entitled "Passenger Fees" of Section II entitled "Services and Charges" of the Rules, Rates, Charges and Regulations for Port and Harbor Facilities, Seward, Alaska" is amended as follows: 230 PASSENGER FEES (a) Fee. In addition to other tariff provisions, the terms and conditions of this item apply and charges are assessed to passenger vessels, sport fishing vessels, guide and outfitter vessels, and all other vessels carrying passengers for compensation. A passenger fee of$1.50 per passenger shall be paid for each passenger embarking or debarking a vessel at a City Dock, as such term is defined in subsection 100 hereof The passenger fee is assessed once per passenger per excursion regardless of whether the passenger excursion is one-way or round-trip. As used in this subsection, "compensation" means payment to the vessel owner or operator whether by charter or through fares paid by or on behalf of passengers. Section 3. Subsection 230(b) "Exceptions" is deleted. Section 4. The passenger fees described in Section 2 above shall be collected and paid to the City beginning January 1,2001 and shall continue until such time that there are no longer any outstanding Parity Bonds as defined in Resolution No. 94 relating to the issuance of harbor revenue bonds. Section 5. Prior to January 1,2001 and each January 1 thereafter, operators of affected passenger vessels shall complete a passenger fee registration form provided by the City. Passenger fees shall be paid and reported to the City montWy, on a form provided by the City, by the 10th of the month following the month for which the fees are due. Section 6. This resolution shall take effect ten (10) days following its adoption. PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this lIth day of September, 2000.
