RESOLUTION 2000-101
A RESOLUTION OF mE CITY COUNCIL OF mE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO TRANSFER $20,000
FROM ELECTRIC DEPARTMENT RETAINED EARNINGS ACCOUNT TO
THE ELECTRIC DEPARTMENT LEGAL BUDGE, AND AUTHORIZING
THE CITY MANAGER TO ENTER INTO A CONTRACTWImKEMPPEL,
HUFFMAN AND ELLIS, PC TO PROVIDE LEGAL SERVICES FOR AN
AMOUNT NOT-TO-EXCEED $25,000.
WHEREAS, legal expenses for the continued negotiations with Marlow Power and Steam
continue to occur; and,
WHEREAS, the Legal firm of Kemp pel, Huffman and Ellis, PC has been retained to assist
the City in these negotiations because of their expertise in this particular field; and,
WHEREAS, the same firm of Kemppel, Huffman and Ellis, PC is assisting the City in
negotiations with Chugach Electric Association for a renewed power sales contract; and
WHEREAS, the Electric Department Legal Budget has been used up in these negotiations
and requires a transfer of $20,000 from Electric Department Retained Earnings; and
WHEREAS, the firm of Kemp pel, Huffman and Ellis, PC has exceed the $10,000 limit:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to transfer $20,000 from Electric Department
Retained Earnings, Account 501-0000-3050 to the Electric Department Legal Budget, Account 501-
5400-5170.
Section 2. The City Manager is authorized to enter into a contract with Kemppel, Huffman
and Ellis, PC for legal services not-to-exceed $25000.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 11 th day
of September, 2000.
