HomeMy WebLinkAboutRes2000-114 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2000-114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO AMEND THE LEASE AUTHORIZED BY RESOLUTION 2000-076 BETWEEN THE CITY AND JAMES T. PRUITT BY THE ADDITION OF A STRIP OF LAND TEN (10) FEET IN WIDTH LOCATED ALONG THE SOUTH BOUNDARY OF THE NORTH HARBOR PARKING LOT, TRACT A, BLOCK 1, NORTH HARBOR SUBDIVISION. WHEREAS, the City Council adopted Resolution 2000-076 approving a long term lease (the "LEASE") with James T. Pruitt for the purpose of extending the lease term to take advantage of improved financing arrangements for improvements completed on the Leased Land (as defined in the LEASE), to update the lease agreement using the current form, terms and conditions applicable to new CITY leases, and to establish a legal description ofthe Leased Land by completing and filing a plat of the Leased Land; and WHEREAS, the City Council adopted Resolution 2000-086 authorizing for disposal, by lease through negotiation, a portion of public land described as a strip of land ten (10) feet in width along the south boundary of the North Harbor Parking Lot, Tract A, Block 1, North Harbor Subdivision; and WHEREAS, this resolution also authorized negotiations with James T. Pruitt for a lease amendment to add this strip ofland to the LEASE to resolve public safety concerns and provide for additional space for fuel delivery and other supply vehicles at the Leased Land; and WHEREAS, it is in the public interest to promote continued and increased retail activity of this type within the City and benefit the community through stability, job growth and other related economic impacts; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. It is the public's interest to amend the LEASE with James T. Pruitt to add this additional property to the Leased Land for the reasons stated in the above recitals. Section 2. The City Manager is hereby authorized (1) to amend the LEASE with James T. Pruitt as attached hereto and incorporated herein by reference and in substantial form as attached hereto; (2) to record a lease memorandum to reflect such amendment; and (3) to make such changes to the attached amendment as necessary to finalize amendment between the parties but without changing the substantive terms as described in the attached lease amendment. The terms of the attached amendment may be included in a restatement of the LEASE or by the attached separate lease amendment. Section 3. The lease amendment shall not become effective until the Leased Land is first surveyed and a plat filed to reflect the lease site dimensions, as amended, and the existing easements and the like. The final plat shall be subject to approval at the sole discretion ofthe City through the City Manager. Section 4. The lease rate for the additional parcel of land shall be completed at the rate applicable under the LEASE, subject to a periodic fair market value appraisal as provided therein. For this reason, the public interest will not be served by requiring an appraisal for this lease amendment. Section 5. This resolution shall take effect thirty (30) days after its adoption and posting. PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 23rd day of October 2000.
