RESOLUTION 2000-127
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING CHANGE ORDER NUMBER 3 TO TRYCKNYMAN
HAYES INCORPORATED'S (TNH) ENGINEERING SERVICES
CONTRACT TO ADD EXPANDED CONSTRUCTION ADMINISTRATION
DUTIES FOR AN AMOUNT NOT TO EXCEED $151,880.00
WHEREAS, on April 12, 1999, the City of Seward Council approved the Small Boat Harbor
Repair and Renovation Capital Project and authorized the City Manager to issue a Request for
Proposals (RFP) for engineering services (Resolution 99-008); and
WHEREAS, Tryck Nyman Hayes, Incorporated (TNH) was selected as the engineering finn
to provide the services necessary for the project; and
WHEREAS, on September 14, 2000 at a Special City Council meeting, Resolution 2000-
104 was passed directing the City Manager to prepare a proposal for a Resident Engineer (RE) to
supplement TNH's construction administration duties; and
WHEREAS, the Administration is proceeding with this direction and is progressing with
developing ajob description, with the goal of a successful project, completed on time with
limited changes in mind; and
WHEREAS, Several issues and concerns must be fully investigated to bring this
independent RE on line, among these are 1) a significant potential for disruption between
competing engineering views, 2) the City has hired TNH to design this project and to provide a
certain level of construction administration and a new, independent, engineer working for the
City may have significantly different views, engineering and otherwise, about all areas of the
project construction progresses, causing conflicts, delays and cost over-runs; and
WHEREAS, the engineer that works as the RE must be up to speed on design, history,
meetings, operational issues and prior decisions and supportive of the design in order to insure
proper construction, adding significant time and cost to the RE contract; and
WHEREAS, TNH has a vested interest in getting this project completed on time, within
budget and within design specs and there is a real potential to create a difficult logistical situation
by putting an independent engineer in between the City and the contracted design engineer; and

WHEREAS, there exists a contractual agreement with TNH to provide a level of
construction administration services and great care must be exercised in identifying construction
administration duties of the RE as they relate to the existing contractual agreement with TNH to
avoid potential contract disputes and potential breech of contract actions; and
WHEREAS, in order to meet the goals of the City Council and avoid engineering,
contract and design disputes, TNH was asked to provide a proposal to add to the existing
engineering services contract for Construction Administration Services; and
WHEREAS, this proposal expands the contract administration duties in the existing
contract under Task 5, meets the goals of the City Council as expressed in the September 14,
2000 Special Meeting and adds $151,880.00 to the contract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Council approves Resolution 2000-127 approving Change Order Number 3 to Tryck Nyman Hayes
Engineering Services Contract to add expanded construction administration services per the attached
proposal for an amount not to exceed $151,880.00 and authorizing the City Manager to issue the
appropriate Notice(s) to Proceed in accordance with the existing contract with Tryck Nyman Hayes,
Incorporated.
Section 1. The City Manager is authorized to issue Change Order Number 3 to the
existing contract with Tryck Nyman Hayes, Incorporated, to expand the construction
administration services under Task #5 and issue appropriate Notice(s) to Proceed for these
expanded services.
Section 2. The amount of this change order is not to exceed $151,880.00 and shall be
charged to project 315-3150-5390, purchase order number 24548.
Section 3. This resolution shall take effect on immediately upon adoption.
