ORDINANCE 2007-005
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING AN EXCEPTION TO SCC 3.65.020 TO PERMIT
RETROACTIVE APPLICATION TO JULY 1, 2007 OF PROVISIONS IN A
COLLECTIVE BARGAINING AGREEMENT AS AND IF APPROVED BY
SEPARATE RESOLUTION OF THE CITY COUNCIL
WHEREAS, over the years, the City of Seward and the International Brotherhood of
Electrical Workers, Local 1547, ("IBEW") have negotiated and entered into collective bargaining
agreements that provide for wages and certain other terms and conditions of employment for City
employees covered by said agreements; and
WHEREAS, the last agreement between the City and the IBEW expired on June 30,2007,
but remains in force and effect until renewed or terminated; and
WHEREAS, representatives of the City and IBEW have negotiated in good faith toward a
successor agreement between them, and due to no fault of either party that agreement was not
tentatively agreed upon or ratified until a date later than June 30, 2007, and the parties have agreed to
seek ratification and approval by the City Council of a three year agreement which by its terms
would commence July 1, 2007; and
WHEREAS, SCC 03.65.020 does not permit retroactive changes to wages or working
conditions in a collective bargaining agreement; and
WHEREAS, the City administration has requested that the City Council authorize an
exception to SCC 03.65.020 that would allow the terms of a collective bargaining agreement with a
retroactive effect to July 1, 2007.
THE CITY OF SEWARD, ALASKA, ORDAINS that:
Section 1. After full review by the City Council of the facts and circumstances of
negotiations for a three-year collective bargaining agreement, it is hereby determined that an
exemption from SCC 03.65.020 is warranted if and to the effect that the City Council approves the
terms of the negotiated collective bargaining agreement between the City and IBEW presented to it.

Section 2. The provisions of SCC 03.65.020 which prohibit the retroactive effect of changes
to wages and working conditions shall not apply to a collective bargaining agreement between the
City and IBEW for the term July 1, 2007 through June 30, 2010, if said agreement is approved by
separate resolution of the City Council by December 31,2007.
Section 3. This ordinance shall be a non-code ordinance.
Section 4. This ordinance shall take effect immediately.

Non-Code Ordinance to Allow Retroactive Effect of
2007-2010 IBEW Contract Provisions
BACKGROUND & JUSTIFICATION:
The contract to be presented at the September 10, 2007 council meeting is the result of
negotiations between the City of Seward and representatives of the IBEW and is a "tentative"
agreement subject to council approval. The new contract has a proposed effective date of July 1,
2007 and will continue thru June 30, 2010. Wages and benefits will need to be retroactively
calculated to July 1,2007.
SCC 3.65.020 prohibits retroactive changes to wages or working conditions in a collective
bargaining agreement. This ordinance would exempt the 2007-2010 IBEW agreement from such
prohibition, thereby allowing changes to wages and working conditions to become effective July
1,2007.
The administration recommends approval of this ordinance, consistent with the good faith
negotiations entered into between the parties. The agreement itself is subject to approval by
resolution of council. (Adoption of this ordinance does not approve the contract.)

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA ESTABLISHING SECTION 15.15.025,
HISTORIC PRESERVATION, SEWARD HISTORIC PLANT &
TREE REGISTER
WHEREAS, it is the responsibility of the Historic Preservation Commission to
work toward the continuing education of Seward's citizens regarding local historic
preservation and community history; and
WHEREAS, the Seward Historic Plant & Tree Register is proposed to preserve
and recognize the significant plants and trees in our community; and
WHEREAS, the goals of the Seward Historic Plant & Tree Register are to
recognize and designate individual plants or trees with community significance, educate
the public about the history, promote appreciation and public awareness and to document
and recognize in order to foster the willingness to protect those plants and trees as part of
Seward's heritage and provide a valuable historic resource; and
WHEREAS, the Seward Historic Plant & Tree Register will complement the
Seward Register of Historic Places.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA that:

C. The Historic Preservation Commission shall recommend
nominations to the Seward Historic Plant & Tree Register to the City Council.

Section 2.

BACKGROUND & JUSTIFICATION:
Since 2005, the Historic Preservation Commission has discussed creating a Seward
Historic Plant & Tree Register. Numerous work sessions have been held discussing the
merit of the project, developing a program to recognize and designate trees and plants of
local historic significance and to discuss the application process. On May 22, 2006
Council approved Resolution 2006-059, supporting the Historic Preservation
Commission Project to research and develop a local register of Historic Trees and Plants.
Following Councils support the Historic Preservation Commission continued to research
and develop the register.
The Seward Historic Plant & Tree Register increases public awareness about the
important contribution of Seward's locally significant trees and plants to Seward's
history and heritage. It provides and encourages the preservation of these assets and
provides the public with a valuable historic resource.
On August 1, 2007, the Historic Preservation Commission unanimously approved
Resolution 2007-03, establishing the application procedures and eligibility criteria for
nominations to the Seward Historic Plant and Tree Register; and approved forwarding the
attached Ordinance to Council for enactment.
CONSISTENCY CHECKLIST:
Where applicable, this ordinance is consistent with the Seward City Code, Charter,
Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of
Procedures.
The City of Seward Comprehensive Plan encourages preservation of historic landscaping
and supports the Historic Preservation Commission's efforts to raise public awareness
regarding the inventory of local historic properties; those properties listed on local, state
and national registers; and benefits of placing properties on these registers (pages 29-30).
The Seward Historic Plant & Tree Register strives to meet these plans set out by the City.
Hopefully, once the public becomes aware of the local trees and plants and their
significance to the community, this awareness will encourage preservation and the desire
to protect these assets for years to come.

Section 1. The following procedure will be used to nominate a plant or tree to
the Seward Historic Plant & Tree Register:
1. Obtain an application (sample attached) and cover letter from the City
Community Development Department, Seward Museum or Community
Library.
2. Submit fmal application to Seward Historic Preservation Commission for
approval and recommendation to City Council.
3. The City Council will add the plant or tree to the local register by
resolution.

Section 2. To be eligible for Seward Historic Plant & Tree Register
consideration, the plant or tree must meet the following criteria:
1. Is located between Caines Head in Resurrection Bay and the head of
Kenai Lake.
2. Designated as significant on the basis of its importance to Seward's
history by being incorporated in one or more ofthe following categories:
a. Specimen: A tree or a plant of exceptional size, form, or unusual or
rare traits.
b. Historic: A tree or plant recognized by virtue of its age, its association
with or contribution to an historic structure or district, or its
association with a noted person or historic event.
c. Landmark: A tree or plant that is a landmark of the community.
d. Collection: A tree or plant in a notable grove, avenue or other planting.
e. Commemorative: A plant or tree planted to commemorate a person or
event.
Section 3. The attached proposed ordinance creating a Seward Historic Plant
& Tree Register is forwarded to the City Council for introduction and adoption.
Section 4.
The resolution shall take effect immediately upon enactment.

THREE YEAR CONTRACT WITH THE INTERNATIONAL BROTHER-
HOOD OF ELECTRICAL WORKERS (IBEW) EFFECTIVE JULY 1, 2007
AND ENDING JUNE 30, 2010
WHEREAS, The City of Seward and the IBEW have negotiated and agreed upon a
new contract governing the wages and working conditions for electrical linemen and
operators employed by the City; and
WHEREAS, The City and the Union agree to the terms and conditions as outlined in
the attached contract which expires June 30, 2010.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into an agreement with the
International Brotherhood of Electrical Workers effective July 1, 2007 and continuing until
June 30, 2010.
Section 2. This resolution shall take effect immediately.

Approval of2007-20l0 IBEW Contract
BACKGROUND & JUSTIFICATION:
The attached contract presented at this meeting is the result of negotiations between the City of
Seward and representatives of the IBEW and is a ''tentative'' agreement subject to council
approval. The discussions were cordial and for the most part, very productive. The new contract
has an effective date of July 1,2007 and will continue thru June 30, 2010. Wages and benefits
will need to be retroactively calculated to July 1, 2007.
Many items were discussed during the negotiations and several items were clarified. The main
changes in the contract and the only ones with a financial impact are:
~ The City agreed to a Health and Welfare payment to IBEW for the benefit of each
employee of $1,128 per employee/month (an increase of $85.00/month) with annual
increases of up to 7% of the increase, covered by the City with all above that percentage
increase covered by the employees.
~ The City agreed to a base rate of$38.16 (an increase of3% over last year) effective July
1,2007, with annual raises during the term of the contract of the Anchorage COLA with
a minimum of 0% and a maximum of 3%.
~ The Alaska Electrical Workers Money Pension Plan changed from a contribution of
$4.00/compensable hour to $800.00/month.
~ The City no longer pays into the Alaska Electrical Legal Fund.
~ The Union agreed to allow Operator/Mechanic position(s).
~ Fewer Linemen will be required to do certain tasks.
~ The City has the right to whoever we need/choose to operate the generators when
Linemen/Operators are not available.
CONSISTENCY CHECKLIST:
Where applicable, and upon adoption of Ordinance 2007- this resolution is consistent with the
Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City
Council Rules of Procedures.
FISCAL NOTE:
The total costs associated with the salary and benefit package depends on the number of total
employees hired in union positions. Base salaries will increase 3% over the prior year. The

change in pension contributions from a per -hour basis to a flat $800 provides predictability, since
the contribution will not change with changes in hours. The monthly contribution to the legal
fund is eliminated, saving $311.40 per employee per year. The City is now authorized to hire
two operators, who are paid at 90% of the lineman hourly rate. These positions allow the City to
perform generator maintenance, grounds keeping, equipment maintenance and other tasks, at a
lower hourly rate.

Silver Salmon Derby. He noted a task force would be assembled from the community to identify
areas of the budget process.

Oates stated ifthe public works shop was combined, the city would have to purchase property
outside the Seward area big enough for a combined site, significant rate increases would be needed
for electric, water and sewer, and the price of building materials was increasing daily while a site
selection process went on. Although this did not offer a solution for the public works shop, and there
would be a minor loss of savings and efficiency by not combining the shops, Oates stated it was time
to address the generator problem now. He stressed the advantages to purchasing the generators,
warehouse and office space were: no rates would be increased, they could bond the project, total
cost to build would only increase with time, it met all immediate and foreseeable needs, could be
used for an EOC or backup location, saved office lease costs, solved equip ffice and storage
needs by combining all electric materials stored in three different locati a expandable, and

The City Manage dated the council on non-compliance of previously passed Resolution
2007-079 by the property owner which addressed levee repairs and subdivision agreements in
the vicinity of Japanese Creek, and his intent to put the repairs to bid and bill the owner for
half the cost of those repairs.
Council member Schafer had a conflict and left the dais and sat in the audience.
Oates referred to the two letters submitted by Afognak Construction which declined paying
for a portion of the levee repairs, and stated the city was forced in a position to put a bid out to repair

the levee with opening on September 18, 2007. Since Afognak was declining in the sharing of
repairs, the city would bilI the property owner for reimbursement. Oates stated the bridge and
culvert were stilI not removed and needed to be before flood season. He also noted the Schafer's
would not elevate to base flood elevation (BFE). Oates reminded that the only reason this was
platted before a subdivision agreement was in place was because of the original plan to locate the
Long Term Care Facility on the property.
Oates further stressed the problem was the letter from Afognak was eliminating the city's
ability to manage the risk ofthe levee. FEMA had determined the city woul eligible for any
federal dollars for building on the alluvial fan. He was told by Nelson & es that the levee
design was curved because it was the only easement they could get fr roperty owner at the

RE: Easement for repairs to the Seward Japanese Creek Levee
Mr. Schafer,
The City of Seward requests a temporary 100 foot construction easement along both sides of
the existing Japanese (Japp) Creek levee easement from Ash Street to the northern boundary
of Afognak Construction & Excavating, Inc. property. The City also requests a temporary
100 foot construction easement on the western (creek side) of the existing levee easement
:from Ash Street to the southern boundary of Afognak Construction & Excavating, Inc.
property. These easements are necessary to repair the levee. It is anticipated that these repairs
will take place during the months of September and October 2007.
In order to obtain a temporary floodplain permit request your response, including your terms
and conditions, be received no later than Friday, 3 I August 2007.

Mr. Schafer,
Under Section 1, Item 1, of City of Seward Resolution 2007-79, the City Council directed
me to take action that would accomplish removal of the road, bridge, and culvert in
Japanese Creek (also referred to as Japp Creek). This is the same issue that was addressed
by the recent interim City Manager, Marvin Yoder, with the State of Alaska. In a letter
dated 4 January 2007, Mr. Yoder made a statement that "the owners of the property in the
Japp Creek drainage have agreed to remove the bridge structure as soon as conditions on
the ground permit."
Please consider this letter an official request by the City of Seward that Mognak
Construction & Excavating, Incorporated remove the road, bridge and culvert in Japanese
Creek. This removal should be accomplished no later than Friday, September 14, 2007. If
an extension of time is necessary, please provide justification for such a request to this
office no later than September 11, 2007.
