U.S.S. 1864, (Preliminary Plat); and Wf1EREAS, at the September 4, ?007 Planning and Loiwig meeting the Coaunission supported raid reconuncndcd Zoning and Land Use Map amendments to change Tract [), Seward Long Term Care Facility Subdivision, USS 1864, (Preliminary Plat) Isom Single gamily Residential (K1) to Institutional (INS); and WIIEREAS, on November 26, 2007 Seward City Council appruveJ Ordinance 2007- 007, amending the. Land Use Map and the Rewning of Tract D, Seward i.ong Temi Care Facility Subdivision, USS IR64, (Preliminary Plat) from Single Family Residential (Rl) to Institutional (1NS); and WHEREAS, according to the Seward City Codc, Land Uses Allowed "Fable 15.10?25, facilities such as the planned LTCF development are allowed in the institutional7.oning llistrict as a conditionally permitted use; and WHEREAS, although the Greenhouse Facility (I lousing nursing, retirement, wnvalescent home) requires institutional coned property, the philosophy and housing facilities are residential in naturo; artd WHEREAS, the intent is to provide a true residential neighlxirhood by clustering the housing units and also providins laudscapc bull'ers w the adjacent residential and institutional wuing districts; and Seward Planning and Zoning Cumntission Resolution 2007-2U Page 2 of 5 WHEREAS, this facility will he comprised of four (4) single story ten (lU) resident rJ homes and a single story `commons' building to provide support to the homes with the possibility of adding two (2) additional homes in the future; and WH1r:REAS, nn January 9, 2W6, by Resolution 2006-04, Seward City Council endorsed Seward's LTCP as an ollicial Green Housed pmjec;t; un June 2S, 2007 by Resolution 2UU7-(iU Council approves the acquisition of Tract D, USS 1864 Long Term Care Facility preliminary n:plat, and nn July 9, 2007 by Rcsohrtion 2007-63 Council approved additional funding fur the site re-design by Architects Alaska of the LTCF located nn the new site localiun of'I'ract D; and WIfEREAS, Nuvcntbe;r 13, 2007 the Planning and Zoning Commission and Architects Alaska he1J a public work session to review and discuss the LTCP site plea and Conditional Use Ycnnit application; and WHEREAS, as required by Title 15 of Seward City Cude, public notice and public hearing procedures for gtantirtg a Conditional Use Permit, all pmperty owners within three hundred (3UU) feet and in addition all local property owners who use the Forest Acres road network were notified and the propcRy was posted with public notice sign; and WH1h;RF.AS, having complied with the public notification process, nn December 4, 2007, the Seward Planning and "Coning Commission held the required public hearing un the Conditional Usc Permit application. 1\O~v, '1'HF.RF.FORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. Acwrding to SCC 15.10.320.D., the Cununission shall establish a lording that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose ojthu chapter (the Seward Zoning Code) and thr purpncec ojthe zoning district. Finding: 't'his finding has been met. The property is currently zoned lnstimtional. 't'he institutional Zoning district provides an area for public and private health care uses (SCC (5.05.025. (b) (11). Tract D, USS 1864 (Preliminary Replat) is a large an approximately 8 acre parcel located to the south of the Forest Acres residential subdivision. Tract D is adjoined to the South and Gast by the large approximately 51.8 acre parcel owned by the Kenai Peninsula Schuul Uistrict. This parcel is zoned lrrstitutioiu+l and currently contains the Seward public schools.
