Swalling was unable to install the owner furnished tie back wall system provided by the City because rods, nuts and couplers were not properly sized for the coating applied by the manufacturer. To facilitate installation of the tie back wall system the rod coatings and galvanizing on the rod nuts and couplers was removed. Swalling was instructed by the City to seal the tie back system at the locations where coatings on the owner supplied materials have been compromised or damaged. The manufacturer, Skyline Steel. has agreed to reimburse the City for the additional costs not to exceed $19,230.00 CONSISTENCY CHECKLIST: Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures. Other: FISCAL NOTE: All repair costs are to be reimbursed to the Ci~ Skyline Steel. Aprroved by Finance Derartment: RECOMMENDATION: City Council approve Resolution 2008-027, authorizing the City Manager to amend the contract with Swalling Construction to repair and coat the rod ends, couplers, rod connection points, plates and washers, to be reimbursed by Skyline Steel Sponsored by: Oates CITY OF SEWARD, ALASKA RESOLUTION 2008-027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO AMEND THE CONTRACT WITH SWALLING CONSTRUCTION FOR THE PURPOSE OF REPAIR TO INCLUDE ROD ENDS, COUPLERS, ROD CONNECTIONS POINTS, PLATES AND WASHERS AND ALSO INCLUDES ONE COAT OF COROTHANE COATING IN AFFECTED AREAS, TO BE REIMBURSED BY SKYLINE STEEL WHEREAS, the City is constructing a new 50-ton lift dock; and WHEREAS, the contractor, Swalling Construction, was unable to install the owner-furnished tie back wall system without modifications, because rods, nuts, and couplers were not properly sized for the coating applied by the manufacturer; and and WHEREAS, time is of the essence, so as to mitigate schedule and cost impacts; WHEREAS, this work is to be reimbursed to the City by the manufacturer, Skyline Steel. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is hereby authorized to execute Change Order No.l with Swalling Construction for the purpose of repairs to include rod ends, couplers, rod connection points, plates and washers, with said parts to receive one coat of Corothane coating at a price not-to-exceed $19,230.00. Section 2. The City Manager is hereby authorized and directed to bill Skyline Steel for the full price of the repairs and coatings. Section 3. This resolution shall take affect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 14tH day of April, 2008.
