HomeMy WebLinkAboutRes2008-080Sponsored 6y: Oates CITY OF SEWARD, ALASKA RESOLUTION 2008-080 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING CHANGE ORDER #8 TO THE CONTRACT WITH WM. J. NELSON AND ASSOCIATES FOR ENGINEERING AND CONSULTING SERVICES ON THE JAPANESE CREEK LEVEE, AND APPROPRIATING FUNDS WHEREAS, the Seward City Council has authorized the city manager to pursue final permits to construct the North Forest Acres Japanese Creek levee project, and those project permits have been submitted to appropriate federal, state, and local government agencies for approval; and WHEREAS, the administration is prepared to move forward with property appraisals and property negotiations as approved by the Seward City Council in Resolution 2007-041 on Apri123, 2007, with final approval of any property, easement and/orrights-of--way purchases to be approved by the City Council; and WHEREAS, the firm of William J. Nelson and Associates ("Nelson") manages the engineering and consulting services for this project on behalf of the City, and the project now requires property appraisals and acquisition services in order to proceed with the acquisition of property, easements, and/orrights-of--way; and WHEREAS, the levee footprint requires appraisals for approximately 24 parcels to be conducted by a third-party appraisal firm at an estimated cost of $75,000, plus property negotiations and acquisition services ~rr.r to be conducted by HDR, Inc. at an estimated costs of $95,000, for a total change to the contract with Nelson in an amount not to exceed $187,000, including a 10% contingency, with said fees to be paid from State grant funds available for this project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is hereby authorized to approve contract change order number 8 with William J. Nelson and Associates to reflect an increase of $187,000, including a contingency of $17,000, to cover additional consulting costs associated with the North Forest Acres levee project. Section 2. The amount of $187,000 is hereby appropriated from the NRCS Flood Mitigation Proj ect grant accou- nt no. 666-6660-3050 to the contracted services account no. 666-6660-5390. Section 3. J. Nelson & Associates Contract BACKGROUND & JUSTIFICATION: The Seward City Council authorized the city manager to pursue final permits to construct the North Forest Acres Japanese Creek levee project, and those project permits have been submitted to appropriate federal, state, and local government agencies for approval. The project has now reached the point where the administration is prepared to enter into negotiations with property owners for land acquisition. This is a service that the City has historically contracted out to an agency with experience in property negotiations. The City Council passed Resolution 2007-041 on April 23, 2007, authorizing the city manager to proceed with property negotiations, but the administration needed to wait until we were closer to receiving approval of the permits, in order to know which particular parcels would be affected by the alignment. Once the negotiations are concluded, the Council with have final approval authority for any property, easement and/or rights-of--way purchases. The firm of William J. Nelson and Associates ("Nelson") manages the engineering and consulting services for this project on behalf of the City, and will oversee the appraisal services and the property negotiation services. The levee footprint requires appraisals for approximately 24 parcels to be conducted by a third-party appraisal firm at an estimated cost of $75,000, plus property negotiations and acquisition services to be conducted by HDR, Inc. at an estimated costs of $95,000, for a total change to the contract with Nelson in an amount not to exceed $1$7,000, including a 10% contingency, with said fees to be paid from State grant funds available for this project.
