HomeMy WebLinkAboutRes2008-089Sponsored by: Oates CITY OF SEWARD, ALASKA RESOLUTION 2008-089 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CLOSE-OUT OF THE OCTOBER 2006 FLOOD DISASTER PROJECT, AND APPROPRIATING FUNDS WHEREAS, the city of Seward and other areas of the Kenai Peninsula Borough experienced a major flood event in October 2006 which caused more than $600,000 in damage to local roads, bridges, and other infrastructure; and WHEREAS, a state disaster was declared by the governor of the State of Alaska, followed by a federal disaster declared by the president of the United States, thereby enabling the City to pursue state and federal reimbursement of a substantial portion of flood related repairs and debris removal costs; and WHEREAS, the City of Seward qualified for more than $565,000 in reimbursement from FEMA, leaving $48,200 in un-reimbursed flood-related costs associated primarily with damage to the levee and with employee costs and other costs in excess of initial damage survey report cost estimates; and ,,~ WHEREAS, the City received a State legislative grant to assist with costs associated with levee repairs and debris removal, and $25,019 of the flood costs ineligible for FEMA reimbursement are eligible for reimbursement from the State of Alaska, with the remainder to be paid from the City's General Fund. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is authorized to request reimbursement of the levee repair costs associated with the 2006 October flood event, utilizing State legislative grant funds. Section 2. The amount of $25,019 is hereby appropriated from the State grant revenues account 666-0000-3071-0866, and $23,181 is hereby appropriated from the General Fund fund balance account no. 101-0000-3071-0866, to the October 2006 Flood Project account no. 866-8662- 5380. In all, the City expects to receive more than $550,000 in FEMA funds to reimburse costs associated with flood damage and debris removal. The City was denied reimbursement for $48,200 in flood-related cost that were ultimately determined ineligible for federal disaster assistance funding. Approximately $25,019 of those costs were related to repairs to the Japp Creek levee, with the remainder of the costs being unreimbursed (ineligible) employee costs and other costs which exceeded initial damage survey report cost estimates. FEMA's decision to deny reimbursement for levee repair costs resulted from the inability of the City to demonstrate an ongoing effort to remove bed load and debris from Japp Creek. The City also sought FEMA assistance to remove flood-related debris from Japp Creek. Although the City was able to demonstrate (utilizing pre- and post-flood data compiled by Northwest Hydraulic Consultants, Inc.) the amount of debris deposited as a result of this single flood event, and was limiting its request for funding to that specific level of debris removal plus corresponding levee repair costs, the request was denied by FEMA. CONSISTENCY CHECK: Where applicable, this agenda statement is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures. Other: FISCAL NOTE: The City will utilize $25,019 of the State legislative grant for levee repairs to cover the costs of the Japp Creek levee repairs, with the remaining $23,181 to be appropriated from the fund balance of the General Fund. RECOMMENDATION: City Council approve the close-out of the October 2006 flood event, and appropriate funds. `{~
