RESOLUTION 2008-19
A RESOLUTION OF THF. SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA,
GIZ4NTING A THIRD SIX MONTH EXTENSION TO
CONDITIONAL USE PERMIT NO. 2007-03, [SSUED TO TOM &
LORI SWANN FOR THE DF,VELOPMENT OF AN 11-ROOM
HOTEL AT 504 ADAMS STRF.F,T LOCATED IN A CENTRAL
BIJSINF,SS 7_ONINC DISTRICT (CBD)
WHEREAS, on April 5, 2007 the Planning and Zoning Commission approved
Resolution 2007-OS granting a Conditional Usc Permit (CUP) to Tom and Lori Swann [or
the development of an 11 room hotel at 504 Adams Street; and
WHEREAS, the Seward Zoning Code (SCC) §15.10320.G(I) stipulates an
approved CUP lapses six (6) months after approval if no building permit is procured or if
the allowed use is not initiated; and
WHEREAS, (SCC) §15.10.320.G(2) states the Commission may grant time
extensions not to exceed six (6) months each upo^ a finding that circumstances have not
changed sufficiently to warrant a reconsideration of the approval of the CUP; and
WHEREAS, on October 4, 2007 by Resolution 2007-I7 the Planning and Zoning
Commission issued a six month extension to the original CUP 2007-03; and
WHEREAS, on May 8, 2008 by Resolution 2008-10 the Planning and 7.oning
Commission issued a second six month extension to the original CUP 2007-03; and
WHEREAS, "I~om and Lori Swann have submitted written request for a third
sixth month extension to CUP 2007-03 stating there have been no changes to the original
plan.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section L Circumstances have not changed sufficiently to warrant reconsideration of the
Conditional Use Permit 2007-03 issued to Tom and Lori Swann on April 5, 2007;
-- extended by Resolution 2007-17 on October 4, 2007; and extended by Resolution 2008-

l0 on May 8, 2008 to develop an 11 room hotel.
Section 2. Conditional Use Permit number 2007-03, issued to Tom and Lori Swann on
April 5, 2007 is hereby granted a third extension until April 9. 2009.
Section 3. "Phis resolution shall take effect immediately upon its adoption.
PASSED AND APPROVEll by the Seward Planning and Zoning Commission this 16th
day of December 2008.
