PI?R SEWARD CITY CODE SI?CTION ]i.10.130, CV '1'Hh: IIARI3OR COMMERCIAL DISTRICT 1VIII:REAS, the City received a request from the Alaska SeaLitc (`enter (ASLC) for permission to erect an ,4laska Harbor Observation Nehvork Tower (harbor obsen~ation tower) o^ the breakwater crest of the South I Itu•bor Uplands: and WH E REAS, the Cite zoning code dues not list a harbor observation tower as an allowed use, but this type of tower is eligible for consideration as an unlisted use; and WHh:RE.AS. U~c prototype is a paruiership between ASLC the University of Alaska Anchorage (IJAA). and the National Oceanic and Atmospheric Administration (NOAA) through the Alaska Ocean Observing System (AOOS): and WHEREAS, the harbor observation tower will provide benetit to Seward and the entire State of Alaska by reporting and t~xecasting coastal marine conditions, monitoring the impacts of climate change, provide domain awareness for security and disaster response, provide data fi>r ci~asta) inti•astructure design, and provide a Tsunami warning system feature: and WHEREAS, because of these numerous henetits and project objectives, ii is in the public interest to allow the I~iarhor observation tower as an unlisted use in the I larbor Commercial District; and WHEREAS., prior to construction, the harbor observation tower must obtain all necessary permits and permissions Isom local, state and federal officials: and WHEREAS. prior to construction, the harbor observation tower mull comply with all local. state and lederal laws and regulations. NOW, THEREFORE, BE f"1' RESOLVED b_v the Seward Planning and 7,oning Commission that: Section 1. Fur the reasons stated in the recitals, which are incorporated as if fully set t2~rth herein. the Commission, according to SCC I ~.] 0.130_ establishes a written decision that the unlisted use satisties all the lblluwing conditions: (1) "l~he use is not specifically permitted in a any other district: Findin;;: This condition has been met. 'fhc harbor observation tower must be positioned on the breakwater crest of the harbor entrance for precise data collection. Accw~ate marine observations can not be made in other locations, or coning districts, in Seward. (i) The use is consistent w~iLh the purpose of the district in question, and is similar to the other uses pcrmiued outright. Finding: The condition has been met The liarhor commercial district is the area for water-depended or water related uses with a particular emphasis on transportation, tourist, recreational, commercial or industrial enterprises which derive major economic or social bcnetit from a harbor location.
