A RESOLUTION OF THE SEWARD PLANNING AND 70NING
COMMISSION OF THE CITY OF SEVVARU, ALASKA, GRANTING A
SECOND SIX MONTH I?XTENSION TO CONDIT[ONAL USE, PERMIT
NO. 2008-03, ISSUED TO NATHAN ORR FOR THE REMODEL AND
CONSTRUCTION OF A 34 UNIT MOTEL ON LOT 3A, BLOCK 18,
FEDERAL ADDITION, ORR REPEAT, 909 FOURTH AVENUE WITHIN
THE CF.NTRA1. BUSINESS DISTRICT
WHEREAS, on April 15. ?008 the Planning and Zoning Commission approved
Resolution 2008-06 granting a Conditional Use Permit (CUP) to Nathan Orr to remodel,
construct and operate a 34 emit motel on I.ot 3A, Block 18, Federal Addition, Orr Keplat, 909
Fourth Avenue; and
WHEREAS, the Seward Zoning Code (SCC) § 15.1 Q320.G(1) stipulates an approved
CLIP lapses six (6) months alder approval if no building permit is procured or if the allowed use
is not initiated: and
WHF.RF.AS, (SCC) §15.10320.G(2) states the Commission may grant Time extensions
not to exceed six (6) months each upon a finding that circumstances have not changed
suCliciently to warrant a reconsideration of the approval of the CUP; and
WHEREAS, nn October 21, 2008 the Planning and Zoning Commission approved
Resolution 2008-15 granting a six (6) month extension to original Conditional Use Permit
number 2008-0,; and
WHEREAS, on March 17, 2008. Nathan Orr requested a second six month extension of
CUP 2008-03, slating within the request there had been no changes to the original plan.
NOW, THEREFORE,, BE IT RESOLVF,D by the Seward Plaiming and Zoning
Commission that:
Section 1. Circumstances have not changed sufficiently to warrant reconsideration of the
Conditional Use Permit issued to Nathan Orr on April 15, 2008 to remodel and construct a 34
unit motel on Lot 3A, Block ] 5, Federal Addition, Orr Replat.
Section 2. Conditional Use Permit number ?008-03, issued to Nathan Orr on April 15, 2008
and extended on October 2l, 2008 is hereby issued a second extension until October. 2009.

Section 3. 1~his resolution shall take eflect immediately upon its adoption.
