Adjournment Historic Preservation Commission Regular Meeting Agenda July 21, 2010 2 Historic Preservation Agenda Statement Meeting Date: July 21, 2010 Of SFy, To Historic Preservation Commission t51 From: Patricia Linville, HP City Liaison Agenda Item: 2010 Historic Preservation Award BACKGROUND & JUSTIFICATION: At the recommendation of the Commission the City Council established an annual Seward Historic Preservation Award. The purpose of the award is to recognize local preservation efforts and encourage community understanding and appreciation of Seward's history. Anyone who has contributed towards local historic preservation is eligible for the award. Award recipients are recognized with a city proclamation and their name engraved on a plaque that is located in City Hall. In the past, recipients have been recognized by the City Council in March around Seward's Day, and/or in May during National Historic Preservation Week. When the award was announced to the public in April no nominations were received. Possible candidates for the award were listed by the Commission during discussion at the June 16 meeting. The Commission asked that they receive that list at this meeting in order to consider and choose a recipient for 2010. Persons listed to receive the 2010 Historic Preservation Award are: • Tom Swan- former Commissioner, preservation work on the Odd Fellows Hall • Dan Seavey - Historic Iditarod Trail Alliance • Seward Rotary- Cemetery work • Carol Griswold- Seward Light and Power Building designation on the Seward Historic Register • Shannon Kovac -Hoben Park (Tom Swann nomination per phone conversation on July 13, 2010) The procedures to nominate an individual for the award were established by Historic Preservation Resolution 95 -09, which staff has provided with this agenda statement. Discussions and motions by the Commission in the past several years have supported the Annual Award be presented to only one recipient per year. A list of past recipients of the Historic Preservation award is attached. RECOMMENDATION: Discuss the 2010 Historic Preservation Annual Award. Decide whether to follow established nomination procedure as outlined in HP Resolution 95 -09 or take alternative action. 3 Sponsored by Staff CITY OF SEWARD, ALASKA HISTORIC PRESERVATION COMMISSION RESOLUTION NO. 95-09 A RESOLUTION OF THE SEWARD HISTORIC PRESERVATION COMMISSION, RECOMMENDING THAT THE SEWARD CITY COUNCIL ESTAB- LISH AN ANNUAL SEWARD HISTORIC PRESERVATION AWARD WHEREAS, it is the responsibility of the Historic Preservation Commission to work toward the continuing education of citizens regarding local historic preservation and community history; and WHEREAS, an annual Seward Historic Preservation Award will serve to publicly recognize the citizens in the community who contribute to historic preservation in Seward; and WHEREAS, the award will educate and raise the pubic awareness regarding the importance of local historic preservation. NOW, THEREFORE, BE IT RESOLVED by the Seward Historic Preservation Commission that: Section 1. The following procedure will be used to nominate an individual for the Seward Historic Preservation Award: 1. Nomination forms may be received from the City Community Development Department, Seward Public Library or Seward Museum. 2. Nomination forms must be submitted to the Community Development Department by February 1st of each year. All nominations must include the nominee's signature of consent. 3. The Historic Preservation Commission will evaluate the nominations, choose the award recipient(s) and the City Council will award the individual(s) through proclamation in March of each year. Section 2. The proposed resolution, attached and incorporated herein by reference, recommending that the City Council establish the annual Seward Historic Preservation Award, is forwarded to the City Council for consideration. Section 3. This resolution shall take effect immediately upon its adoption. Nominee's Address: Phone: Submitted by: Contact Phone: Historic Preservation Agenda Statement eoF set Meeting Date: July 21, 2010 To: Historic Preservation Commission From: Library Director, Patricia Linville Agenda Item: Grant Lake/Falis Creek Hydro Section 106 Consultation Update BACKGROUND & JUSTIFICATION: The Kenai Borough Assembly discussed and voted down a resolution to have the Assembly write a letter in opposition to the Grant Lake Hydro project at their June 22, 2010 meeting. Sue McClure, Assembly Member, related to me that the letter to oppose the project was probably too early in the process. It did however enable those in the area an opportunity to voice their opinions. She said the process is just starting and there will be much discussion as it moves forward. She has given me a detailed description of the project and the process that is available for your review. As it is lengthy I will print only for those who request a copy. Linda and Tim attended the teleconference on June 24, 2010 and will report their observations. RECOMMENDATIONS: Linda Lasota and Tim Sczawinski will give a synopsis of the teleconference and suggestions for future action if any. 8 Historic Preservation Agenda Statement a of SF4, co Meeting Date: July 21, 2010 `�.. 1 1:4 - s o To: Historic Preservation Commission From: Library Director, Patricia Linville Agenda Item: Discussion of Future Grant Projects BACKGROUND & JUSTIFICATION: Commission and staff have indicated a desire to list future grant projects in an effort to be prepared for the short lead time given from the initial grant announcement to submit deadline of the CLG grants. A partial list of possible projects is attached along with the HP priority list. The priority list is intended as an aid /guide for the discussion. RECOMMENDATIONS: Commission create a list possible future grant ideas. 9 Future CLG Grant Ideas 1. Take photos of items in the cemetery and put the on the HP website or create a book (in -kind match). 10 Seward Historic Preservation Commission 2010 - Priorities List 2011 Public Outreach 1. Historic Preservation Website- Continual updating, work on the Seward Register Sites 2. National Historic Preservation Month- Continue to participate and plan celebrations for the recognition of H.P. Month. The scope of the activities will vary from year to year, but activity needs to be identified many months in advance. a. The month of May is Historic Preservation Month b. Place the National Historic Preservation Month on the January Agenda 3. Seward Annual Historic Preservation Award- Continue to solicit candidates. a. The Historic Preservation award may be given in May. b. Place the Seward Annual Historic Preservation Award on the January Agenda. c. Schedule annual work session to discuss future grant applications * Required by City Code Updated May 12, 2010 PL 2IPage 12 City of Seward, Alaska Historic Preservation Commission Minutes June 16, 2010 Volume 2, Page 18 9 Call to Order The June 16, 2010 regular meeting of the Seward Historic Preservation Commission was called to order at 6:30 p.m. by Chair Linda Lasota. • Opening Ceremony Commissioner Hamner led the Pledge of Allegiance. Commissioner Lasota welcomed the new commissioners. Roll Call There were present: Chair Linda Lasota presiding, and Ryan Reynolds Dave Hamner Tim Sczawinski Cathy Richardson Absent was John French (excused), Monica Hinders (excused). Comprising a quorum of the Commission; and Patricia Linville, Library Director Special Reports City Administration Report- • Linville welcomed new commissioners. • Linville reported that new HP notebooks will be available soon. She is currently updating them from 2003. • Linville reported that Dan Seavey is working on a grant to create the Iditarod Centennial Memorial Monument for the spring. The sites and work have been donated. Seavey hopes to raise the rest of the money. The entire project has been estimated at $50,000. • Linville happily reported that the City has received $4.7 million for the library museum • project. The project is still scheduled to complete in August 2012. A work session for project details has been rescheduled to June 29 at 6 pm in the Council Chambers. • Linville added that she is investigating another grant that concerns cemetery information about people buried in Seward Cemetery. She is consulting with copyright professional to learn of copyright issues with obituaries. Other Reports, Announcements & Presentations - Friends of the Jesse Lee Home Update • Lasota suggested a new commissioner fill in Swann's place. 13 W. Photos for CLG Grant 2008 — Lasota • Lasota reported that most of the photos have been taken, but the biggest project is cataloging the photos in a spreadsheet and uploading it to the website. Hoben Park Planter Updates Linville a. Electric department needs to confirm that planters are not interfering with electric conduit under Hoben Park. b. Need permission from SeaLife Center since some of planters may cross property line. Schafermeyer has been contacted. c. Harmon has discussed design of planters for safety and winterizing. d. Commissioner Sczawinski suggested an investigation into Hoben Park as an archeological site. e. Reynolds suggested that the commission could publicize again, but had no suggestions himself. d. Lasota asked for nominations now or next meeting. e. Lasota confirmed that she would register. Linville said that Carney would also attend. c. KPB assembly meeting has a resolution in place scheduled for June 22 covering Moose Pass and Seward area. Lasota recommended the commission pay attention to happenings since that falls within its jurisdiction. Hamner suggested that the Commission's jurisdiction boundaries be brought to the next meeting. *D. May 12, 2010 Regular Meeting Minutes Informational Items — • Hamner asked for new binders to contain current Historic Preservation plan. • Linville requested that updated binder items be digitalized in Word format to create ease of editing throughout the years. • Hamner suggested those files be made available on website for ease of access. During the month of April, quotes were sought from area wide contractors. The first round of quotes were over the budget of the project. A second quote request was sent asking for a break -down of costs in order to determine if the project could be done in phases. There was one response. That contractor has agreed to complete the project as outlined in the grant and donate any costs above $5000. A copy of his quote is attached. Work has been completed on building the forms for the planters. Progress is being made on getting the mold and mix correct as per the attached emails. Due to the delay in finding a contractor the completion date has been moved September 1, 2010. There were no expenses submitted during this quarter. There has been a change in staff which may account for this situation. However, progress on this grant has been made as you will see below: Dan Seavey reports: As of June approximately 30 hours of in -kind effort has been expended • Rock base for the monument has been donated • Moving the rock to the monument space has been donated by Pruitt and City of Seward. • Site is being selected from a site offered by the City along the south end of the bike path. Also under consideration is the end of 3rd Ave at the Sealife Center. • A preliminary design has been developed that is a prospector and freight/pack dog in bronze to sit atop the rock. Informational plaques attached to rock. • Additional funding has been requested from Kenai Mountain Turnagain Ann Heritage Corridor Committee. My initial thoughts are that you would be fine to include any obituaries published pre -1923, as they should be out of copyright. For items published 1923 and later, some research and /or analysis may be necessary to determine whether the obits are under copyright and if so, if the use would be fair. • For items published between 1923 and 1977, if there is no copyright notice, they are in the public domain. However, it may be onerous to find the copyright notice, as it may be anywhere in the paper and rather small. Also, you would need to check each paper that contains an obituary that you would like to use. • For items published between 1923 and 1963 with a copyright notice, copyright status will depend upon whether or not the copyright holder renewed their copyright. While making an official determination is time consuming and expensive, you can make a probable determination fairly easily. So, decisions on whether to pursue this depend both on time available and sensitivity to risk. • Unpublished items, if you find any, have copyright protection for the life of the author plus 70 years. So, if you determine that an obituary is under copyright, can you use it? Under most circumstances, that would require a fair use analysis. As you know, I'm not a lawyer and cannot provide legal advice. Personally, posting obituaries would make me nervous. Since facts aren't copyrightable, I would be very comfortable posting death notices, or facts from obituaries, including citation information for requesting the obituaries through interlibrary loan. The difference, as I see it, is that posting online may result in lots of copies of lots of obituaries, while interlibrary loan is likely to be a much smaller number of copies, and less systematic. Might it be possible for you to get permission from the Seward Phoenix Log, and /or other commonly included newspapers, to post the copyrighted obituaries? I've found that local newspapers are often thrilled to get the information out, as it often makes life easier for them, as well, to be able to refer to a website. They may be less willing with more current obituaries that they may have online themselves, but then, with those you may be able to just link to either the individual obituaries or to the site.
