Adjournment Planning and Zoning Commission Regular Meeting Agenda February 1, 2011 Sponsored by: Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2011 -02 RESOLUTION 2011 -02 OF THE SEWARD PLANNING AND ZONING COMMISSION, CONDITIONALLY RECOMMENDING APPROVAL OF THE STATE OF ALASKA, DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES, MILE 0 TO 8, RIGHT -OF -WAY ACQUISITION PLAT WHEREAS, on or about December 9, 2010, the State of Alaska Department of Transportation and Public Facilities (DOTPF) submitted a preliminary right -of -way acquisition plat to the City of Seward for review and consideration pursuant to Kenai Peninsula Borough ( "KPB ") code 20.04.080; and WHEREAS, the Kenai Peninsula Borough (KPB) is the platting authority for the Kenai Peninsula and KPB code 20.04.080, Right -of -Way Acquisition Plat, establishes the process for final approval of all government agency's right -of -way acquisition plats; and WHEREAS, the approval procedures for right -of -way acquisition plats under KPB code 20.04.080 are not subject to any other plat approval procedures and differ from other preliminary and final platting procedures; and WHEREAS, KPB code 20.04.080.C3 requires review by the City of Seward Planning and Zoning Commission of right -of -way acquisition plats located within the boundaries of the City; and WHEREAS, this proposed final right -of -way acquisition plat provides a visual representation of the Seward Highway 0 -8 project which was constructed during the 2006 building season; and WHEREAS, the portion of the proposed DOTPF 0 -8 Seward Highway Right -of -Way acquisition plat from Mile Zero to the north city limit line of the Seward Highway is located within the City Limits of Seward, and therefore the Commission must review and comment on pages R1 through R25 in accordance with KPB 20.04.080C.3; and WHEREAS, the City of Seward holds numerous utility easements, including but not limited to water, sanitary sewer, and electric utility easements, within the boundaries of this Right -of -Way acquisition project which are not depicted in the proposed plat submitted by the State for final approval; and • Seward Planning and Zoning Commission Resolution 2011 -02 Page 2 of 3 WHEREAS, the portion of the DOTPF 0 -8 Seward Highway Right -of -Way plat from the north city limit line to Mile 8 contains City of Seward electric infrastructure and numerous easements; and Seward Planning and Zoning Commission Resolution 2011 -02 Page 2 of 3 WHEREAS, the portion of the DOTPF 0 -8 Seward Highway Right -of -Way plat from the north city limit line to Mile 8 contains City of Seward electric infrastructure and numerous easements; and WHEREAS, KPB code 20.04.080.D Survey and Monumentation Requirements, provides the minimum monumentation requirements for this replat; and WHEREAS, this replat also notes in several places that all monumentation disturbed or destroyed during the construction of the Seward Highway Project shall be re- established; and WHEREAS, per KPB Planning Commission Resolution 76 -6, all easements of record shall be shown; and WHEREAS, several referenced street names on the preliminary right -of -way acquisition plat are incorrect and should be corrected; and WHEREAS, page R11 of the preliminary right -of -way acquisition plat improperly states that the DOTPF will acquire a slope easement, noted as Parcel E -1, from the City; and WHEREAS, no subdivision installation agreement is necessary, and the construction of the public Right -of -Way has been completed. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission recommends the Kenai Peninsula Borough approve the State of Alaska Department of Transportation and Public Facilities Mile 0 to 8, Seward Highway Project Right -of -Way Acquisition Plat, project number NH- 031 - 1(26), dated September 28, 2001 subject to the following recommendations and conditions: 1. Physically re- establish all monuments that were destroyed during the work of the project, as noted in note number 1 on page R48 through R51. 2. Monument the Right -of -Way, per KPB code 20.04.080.D.1. 3. Update and portray all adjoining lands to current status. 4. Depict all easements of record on the plat, per Borough Planning Commission Resolution 76 -6, including but not limited to city water, sanitary sewer, and electric utility easements. Request and allow further review and comment by the City Electric Department for all area north of the City Limit line to Mile 8 of the Seward Highway. 6. Correct the referenced street names of Cottonwood to Sea Lion Avenue and Leirer Boulevard to Phoenix Road. 7. Remove or correct the note on page R11 referencing an incorrect taking of City property, noted as E -1. 8. Upon final approval and recording the State of Alaska provide a conformed copy of the final right -of -way acquisition plat to the City of Seward, Community Development Department. Section 2. This replat provides a visual representation of the Seward Highway 0 -8 right -of -way acquisition project which was constructed during the 2006 building season. During this project the State of Alaska acquired several pieces of property through the acquisition process, which are depicted on this replat. The Kenai Peninsula Borough (KPB) is the platting authority for the Kenai Peninsula and per the KPB code 20.04.080. Right -of -Way Acquisition Plat, all government agencies' acquisition plats are subject to approval under this code. Section 20.04.080 of the KPB code provides that the procedures set forth in KPB 20.04.080 are the only approval procedures required for final approval. Thus, regular approval procedures for preliminary and final plat approval procedures do not apply to right -of -way acquisition plats. KPB code 20.04.080.C.3 requires review by the Planning and Zoning Commission for any plats located within the boundaries of the City. The replat submitted by the State represents the entire corridor of the Seward Highway from Mile Zero to Mile 8; however the Seward Planning and Zoning Commission shall only provide comments and conditions on the portions within the City Limits; those portions within the City Limits are found on pages 1 through R25 of the submitted replat. Subdivision Review Zoning: The submitted plat abuts numerous zoning districts within the City. Commencing at the southern most end, Railway and Third Ave, and progressing north along Third Avenue to Jefferson, both East and West sides of Third are zoned Central Business District. North from Jefferson to Van Buren Street, the area consists of Central Business, Office Residential, Institutional, and Auto Commercial. Continuing from Van Buren to Port Avenue the area on the East is predominately Harbor Commercial and on the West predominately Park. Continuing from Port Avenue to the City Limit line, the area on the East is primarily Industrial and on the West, Auto Commercial, Institutional and Resource Management. Size: Based on numerous discussions and emails with the State surveyor for this project the only areas affected by this plat are located within the Seward Highway Right -of -Way starting at Milepost 0 and ending at Milepost 8. Based on information provided by the review of numerous plats along this corridor, the Seward Highway Right -of -Way is approximately 80 feet in width from Railway north to approximately Dairy Hill Lane then increases to approximately 100 feet on through the corridor. Utilities: The Seward Highway Right -of -Way contains large amounts of City infrastructure, utility easements including water, sewer and electric, as well as other public /private utilities which are not reflected on this preliminary right -of -way acquisition plat but which have been in existence for several years prior to this project. City staff requests all City utility easements located within this plat be shown on the plat, as required by Kenai Peninsula Borough Planning Commission Resolution 76 -6. Existing Use: The entire corridor is used as the Seward Highway and associated Right - of - Way infrastructure. Flood Zone: Portions of the property are within a FEMA mapped Flood Hazard Zone. Proper Floodplain development permits were obtained prior to the reconstruction of the Seward Highway in 2006. Staff Comments: Community Development staff has held several meetings with department heads to review and discuss this platting action. Many concerns were expressed by staff and have been incorporated in the conditions for approval. The City Electric and Public Works departments supported the concerns stated above regarding the numerous City easements that are affected but not referenced on the plat. Staff also expressed concerns for the re- establishment of the destroyed monuments and property markers. City department heads recommend approval of this replat subject to the conditions noted within Resolution 2011 -02. The City Electric Department also expressed concern that City infrastructure could be affected by any and all platting actions (by the State or others) from Mile Zero of the Seward Highway through to Mile 41 of the Sterling Highway. Noting the City should be provided the opportunity to comment on any and all replats affecting this area. Staff also raised concerns regarding Parcel E -1 on page R11 of the Project document. The State's Project document incorrectly shows that the State acquired a slope easement for this piece of land for right -of -way purposes. This is not accurate and Staff worked with the State Surveyor to correct this error. A revised page R11 now shows Parcel E -1 as properly located outside the State's right -of -way; however, the "Parcel Information" notes on this page still indicate, incorrectly, that the State will acquire a slope easement in this parcel. Staff recommends that this reference be removed before final approval is granted. Staff has worked very closely with and received guidance from the City attorney's office. Public Comment: Notice of the public hearing was published and posted as required by City Code. At the time of this publication, three public comments had been received. One public comment expressed concern for the lack of the re- establishment of the monuments and/or public property comers. Two public inquires were the verification of adjoining parcel locations. Terry stated administration supported the variance request. She noted the Community Development Department worked with the applicant to asure the variance requirements were met. Terry outlined the variance requirements for the Commission and the department's findings. Terry clarified several questions from the Commission. Terry stated a building permit for the WECS foundation had been issued, noting applicant was made aware that the required variance could be denied. Previous applicants have taken the risk of starting a project without all of the required permits, because of the short construction season. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. Fred Esposito, director of the Alaska Vocational Technical Center, asked to speak to the application and the project. Esposito stated the WECS tower was placed in the best possible location. The demands of the short construction season required that the foundation work be completed. In response to a question from Heinrich, Esposito stated the proposed tower and turbine were to be installed by January 1, 2011. Roach thanked Esposito for answering project questions. No one else requested to be heard and the public hearing was closed. Motion (Ecklund/Morgan) Approve Resolution 2010 -14 Morgan stated the apparent risk of the tower failing was very low and asked that the variance request be approved without amendments. Roach' asked Esposito if the plans that had been submitted and acknowledged by neighboring property owners were the same version of the plans included in the variance application. Terry noted the date on the submitted plans. This article, excerpted from one that appeared in the Association of State Floodplain Managers' News & Views, reiterates the rationale for making flood insurance a priority in any community's flood mitigation approach. Self - reliant, sustainable communities know that flood insurance is the only vehicle guaranteed to assure a smooth and complete recovery from a damaging flood. Experience has shown that an insured community recovers more quickly and more thoroughly than it would if no insurance were in place. Consider that: — People without the needed financial resources may not be able to make full repairs to their homes after a flood and may move back into an unsafe or unsanitary structure —if they move back at all. In either circumstance, neighborhoods can be prone to deterioration over time, which tends to result in social problems and also undermines the tax base. — One of out every four damaged businesses does not re -open after a disaster, because they are not financially prepared to do so, according to the Institute of Business and Home Safety. Business closures reverberate through the local economy and the community, as jobs are lost, tax revenues decline, and consumer spending is disrupted. — Very few floods are declared federal disasters. No declaration means no federal grants, loans, or temporary housing funds for the people or for the local government. Renters and homeowners with building and /or contents coverage are assured of quick financial help to recover and to repair or rebuild. Businesses with the proper flood insurance coverage can repair, reopen, and put their employees back to work faster. Further, insured properties are eligible for Increased Cost of Compliance (ICC) payments —an additional source of funding that helps in local redevelopment. All of these circumstances generate a sense of well -being and positive outlook in a flood- damaged community. Local officials can help their communities get ready for the next flood by making flood insurance a high priority. Here are some ideas: — Promote the advantages of flood insurance in town newsletter articles, public service announcements, town events, and other outreach projects. — When residents apply for permits for projects in the floodplain, remind them that their homeowners' policy does not cover flooding, but they can purchase it through their own insurance agent. — Check the amount —and distribution —of flood insurance coverage in your community to see if some areas need to be targeted for receiving additional information. (CRS communities get a list of local flood insurance policies from FEMA once every year). — Supply elevation certificates from your building permit files to insurance agents, real estate agents, and property owners. — Let the insurance agents in your community know that training in flood insurance is available. Better yet, arrange training sessions for them. — Don't forget to explain the Preferred Risk Policy in all your promotional work. — Buy flood insurance for community-owned buildings. This sets a good example and also ensures that the community will have financial resources for repair and rebuilding. Remember, even if a federal disaster is declared, the amount of assistance provided for flood- damaged public property will be reduced by the amount of insurance coverage the community should have had. Reach her at cristina.martinez @iso.com NFIP Extended through September 2011 On September 30, 2010, the President signed a one -year extension of the National Flood Insurance Program. The program had been operating under the latest of a series of short -term extensions since its authority expired earlier this year. The extension provides important stability for FEMA, Write Your Own insurance companies, real estate agents, homebuilders, home buyers and sellers, and policy holders because when the NFIP is allowed to expire, flood insurance policies cannot be purchased or renewed. No other provisions were included in the reauthorization. Instead, FEMA and Congress will continue their consideration of needed reforms to the NFIP and presumably pass a comprehensive bill during 2011. NFIP /CRS Update - 3 - August - September 2010 Ongoing Flood Mitigation pays off for Ottawa, Illinois Community enters CRS as a Class 5 —Scott Cofoid, Insurance Services Office The Fox and Illinois rivers converge at the City of Ottawa, Illinois, and have brought various amounts of damage and disruption to the city over the years. In one problematic neighborhood known as "The Flats," flood waters reached 8 -10 feet high on a fairly regular basis. Floods were recorded in 1974, 1982, 1983, 1997, 2007, 2008 (record flood), and 2009. The city's two high schools, Marquette and Ottawa Township, both have been affected by past flooding. Marquette's football stadium lies in The Flats, and Ottawa Township High School was severely flooded in both 1982 and 1997. The Ottawa Regional Hospital also sits near the Fox River and experiences regular flooding problems. Successful flood fighting saved the emergency room from flood damage during the record flood of 2008. Locally Grown Solutions With the diligent work of community officials over time, Ottawa has achieved notable success in managing its floodplain. Many of the homes in The Flats have been bought out; only a few remain. Much of the area has been turned into Fox River Park, which features water fountains for kids, a Frisbee golf course, a basketball court, a large array of playground equipment, a picnic shelter, a public boat launch, and boat docks. The city worked with the U.S. Army Corps of Engineers to create a levee on the outer perimeter of Ottawa High School, with a secondary flood wall closer to the structure for added protection. The hospital has constructed a flood wall with sluice gates that should protect it from future flood damage. Community officials have also turned around the q thinking of residents living in the floodplain, getting them to understand their risks and what they can do 9 a about them. The city held numerous public meetings to educate, inform, report study findings, and most importantly, get input from those most affected. Tougher floodplain development and stormwater regulations are in place and public outreach has been enhanced. "A critical turning point [was] when the citizens really understood it's not if this happens again but when it happens again. That's the point when real progress was made towards fixing life safety and repetitive loss situations," said Mike Sutfin, Ottawa Building and Zoning Official. Into the CRS Last winter Ottawa began working with Scott Cofoid, from the Insurance Services Office, Inc. (ISO), to explore joining the CRS. After Ottawa's past and ongoing floodplain management activities were documented it was discovered the city qualified for a Class 5— making it already among the top 6% of CRS communities. Ottawa earns CRS credit for public outreach, site visits to help with flooding and drainage problems, higher standards for mapping and regulations, preserving open space, effective stormwater regulations, natural hazard planning, acquisitions (buyouts), and drainage maintenance. Ottawa's residents receive a 25% reduction in their flood insurance premiums as a result. According to Cofoid, Ottawa has a real possibility in the future of becoming the first Class 4 in the Midwest and one of the top 10 floodplain management communities in the nation. "Initially, we just wanted to get in the Program and get started," said Sutfin, "but we are looking to improve that rating in the future." There are an estimated 1200 to 1500 stormwater utilities in the United States, and more are forming all the time, according to a report by Dr. C. Warren Campbell of Western Kentucky University. Students in Professor Campbell's Floodplain Management course have for several years compiled annual data on stormwater utilities, the way in which they set their fees, whether they have been challenged in court and, if so, what the outcome was. Campbell defines a stormwater utility as "a funding approach requiring residents to pay a recurring charge that supports community stormwater initiatives. The fee is dedicated to the maintenance, design, construction, and administration of the stormwater system" with an eye toward managing water quality, quantity, or both. Some CRS communities have found a storm - water utility provides reliable funding support for their credited operations under Activity 450 (Stormwater Management) and Activity 540 (Drainage System Maintenance). Here are some highlights from the report — No community is too small or too large to have a stormwater utility. The smallest community identified was a Florida town with a population of 33; the largest was Los Angeles (population over 3 million). The average size of a community with a stormwater utility is about 82,000. continued on next page NFIPICRS Update - 5 - August - September 2010 Stormwater Utilities — continued from previous page — The rate at which utilities were formed peaked in 2004, largely because of the implementation of the Phase II rules of the National Pollution Discharge Elimination System. The rate has steadied since then but utilities are still being formed here and in Canada. — An ideal stormwater utility (1) Provides adequate funding to meet the legitimate stormwater needs of the community. There can be temptation to underestimate the amount of the fee that will be charged, in order to gain political support for formation of a utility, but a utility with inadequate funding can be worse than no utility at all. (2) Is fairly apportioned according to the amount of stormwater burden produced by a given parcel of land. Various methods are used to set fees, usually based on some estimate of a parcel's stormwater runoff or the extent of its impervious surface. (3) Has a fee system that is simple enough to be readily administered. In 2010, the average monthly single - family residential fee was $4.12 and the median fee was $3.50. Some fees change in accord with the consumer price index and some utilities have lowered their fees. (4) Can stand up in court. Utilities are challenged in court by parties who assert the fee is a tax, or that the fee is not fair, or for other reasons. To date, 29 utilities have been challenged in court. Of those, 21 were upheld, 3 are pending, and 5 were struck down. (5) Can weather political challenges. Sometimes politicians are elected on the promise of doing away with the "rain tax." In that climate, authorizations for utilities can be repealed or provisions enacted to make it cumbersome for a utility to b formed or to operate.
