Adjournment Planning and Zoning Commission Regular Meeting Agenda October 6, 2011 2 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2011 -11 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO COLASKA, dba QUALITY ASPHALT & PAVING (QAP) TO EXTRACT GRAVEL FROM PORTIONS OF THREE PARCELS LOCATED WITHIN THE CITY LIMITS AND THE RESURRECTION RIVER, WITH KENAI PENINSULA BOROUGH TAX PARCEL ID NUMBERS OF 144 -03 -041, 044 & 045, WITHIN THE RESOURCE MANAGEMENT ZONING DISTRICT WHEREAS, Coalaska, dba QAP has applied for a Conditional Use Permit from the Seward Planning and Zoning Commission to extract gravel from the dewatered gravel bars of the Resurrection River within three lots having Kenai Peninsula Borough Tax Parcel numbers and legal descriptions of: 14403041, Section 27 portion NW1 /4 SE1 /4 lying within Seward City limits, excluding West 330 feet; 14403044, Section 27 West 330 feet of NW1 /4 SE1 /4 lying within Seward City limits; and 14403045, Section 27 NE1 /4 SW1 /4; and WHEREAS, these properties are located within the Resource Management Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, "resource extraction, commercial surface, i.e., gravel" is allowed in the Resource Management Zoning District as a conditionally permitted use; and WHEREAS, the applicant has applied for and received both the Kenai Peninsula Borough and City of Seward floodplain development permits allowing for annual extraction of up to 50,000 cubic yards of material; and WHEREAS, the gravel will be used to support and benefit public roads and private properties in the community both inside and outside the City Limits; and WHEREAS, extracting gravel from the dewatered gravel bars of the Resurrection River helps mitigate the flooding by increasing the area available for flood water flows; and WHEREAS, allowing gravel extraction promotes economic development and improvement of infrastructure within the community; and WHEREAS, having complied with the public notification process, on October 6, 2011, the Seward Planning and Zoning Commission held the required public hearing on the 3 Seward Planning and Zoning Commission Resolution No. 2011 -11 Page 2 Conditional Use Permit application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC 15.10.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition has been established at the time of agenda distribution. The property is zoned Resource Management. The Resource Management Zoning District provides for "Lands, which are generally undeveloped and cannot be precisely zoned due to inadequate information on the extension of public services and utilities; the suitability of the land to support commercial, residential, industrial or public uses; and other possible environmental consideration." A gravel extraction operation is allowed in the Resource Management district by conditional use permit from the Planning and Zoning Commission and no adverse impacts to adjoining properties or other properties in the area or the district are anticipated. B. The value of adjoining property will not be significantly impaired Finding: This condition has been met. The neighboring properties, which are within the City limits, are vacant and undeveloped. Since the gravel will be processed, stored and transported on properties outside of City limits, there is minimal impact expected for the adjoining properties within City limits. There is no indication that the development will negatively impact the value of adjoining properties, as properties downstream are being used for a similar activity. Other properties along Resurrection River and Japanese Creek are also used for gravel extraction. There have been no public comments received from the neighboring property owners. C. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: The proposed use is not specifically mentioned in the Seward 2020 Comprehensive Plan (2005) or in the Strategic Plan (1999). However, both plans encourage ongoing and additional economic activities within the community. Seward 2020 Comprehensive Plan (approved by Council, 2005) The Comprehensive Plan has no specific statement relating to this type of an activity. Strategic Plan (1999) The Strategic Plan has no specific statement relating to this type of an activity. 4 Seward Planning and Zoning Commission Resolution No. 2011 -11 Page 3 D. Public Services and facilities are adequate to serve the proposed use. Finding: Water, sewer, and power are not available, but they are not needed for this activity. Emergency service vehicles can access the property from the North via Herman Leirer Road. E. The proposed use will not be harmful to the public safety, health or welfare. Finding: Removing gravel from the dewatered gravel bars of the Resurrection River will increase the area available for flood flows. Extracting gravel is beneficial to the community. A floodplain development permit has been obtained by the applicants. Engineering studies have been completed and all other required permits have been obtained. F. Any and all specific conditions deemed necessary by the commission to fulfill the above - mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above fmdings and conclusions, approval of the CUP shall be subject to the following conditions: 1. This permit only authorizes the activity, if any issues involving stream flow, gravel rights or rights to other resources are involved, the applicants shall address those concerns through separate processes. 2. Riverbanks and riverine vegetation shall not be altered or disturbed during gravel extraction operations. 3. Fuel storage shall not be allowed onsite. 4. Adequate sanitation facilities, such as portable latrines, shall be onsite and removed during periods of non - operation. 5. Issuance of this permit does not alleviate the applicant's responsibility to obtain all local, state and federal permits, as necessary. 6. This permit shall be renewed annually by administration to coincide with the annual renewal of the Floodplain Development Permit, providing all conditions • have been met and renewal of the Floodplain Development Permit is authorized. 7. The Planning and Zoning Commission may modify this conditional use permit if changed uses no longer conform to the standards and legal requirements justifying its present approval, or if the permittee applies for a modification to meet a different development plan that conforms to the standards and legal requirements for approval of a conditional use permit. 8. Any proposed modification plan shall be subject to the public notice and public hearing requirements of law, which shall occur only after payment of the filing fee established by resolution of the city council. 5 Seward Planning and Zoning Commission Resolution No. 2011 -11 Page 4 Section 2. The Planning and Zoning Commission finds that the proposed use, subject to the above conditions satisfies the criteria for granting a Conditional Use Permit provided the conditions listed on Section 1, Subsection F. are met by the applicant, and authorizes the administration to issue a Conditional Use Permit for gravel extraction to Colaska Inc. dba Quality Paving and Asphalt. Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320; Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. This resolution shall take effect 10 days following its adoption. These properties contain approximately 58.97 acres within the City Limits and are vacant and undeveloped. The proposed activity, "resource extraction, commercial surface, i.e., gravel" is allowed in the Resource Management Zoning District as a conditionally permitted use, as per Seward City Code (SCC) Land Uses Allowed Table 15.10.225. The Resource Management Zoning District provides for "Lands which are generally undeveloped and cannot be precisely zoned due to inadequate information on the extension of public services and utilities; the suitability of the land to support commercial, residential, industrial or public uses; and other possible environmental consideration." The applicants have obtained floodplain development permits from both the Kenai Peninsula Borough and the City of Seward which allow QAP to excavate up to 50,000 cubic yards of gravel annually from dewatered gravel bars, in areas in which there is no vegetation. No adverse impacts to adjoining properties within the City limits or other properties in the Resource Management Zoning District are anticipated. Surrounding land uses and zoning: The City Limit Line runs diagonal through the three parcels, placing the access and Borough floodplain management to the North within the Kenai Peninsula Borough jurisdiction. Parcels to the northwest are privately owned and are also divided by the City Limit Line. The parcel to the West is owned by the University of Alaska. Parcels to the South are owned by the University of Alaska and the State of Alaska. The parcels to the East and northeast are privately owned. All parcels are vacant and contain portions of the Resurrection River. All properties with the City 7 Limits are zoned Resource Management. Location: Three parcels south of the City Limit Line within the Resurrection River. Zoning: Resource Management Existing Use: Vacant, undeveloped Proposed Use: Gravel extraction Utilities: None present, not needed for this type of an activity. Emergency service vehicles can access this property from the North, off Herman Leirer Road. Flood Zone: These properties are in a flood zone. Engineering studies have done and a floodplain development permit has been obtained by the applicants. SCC 15.10.140 Definitions: "Resource extraction. Commercial or industrial operations involving the removal of nonrenewable natural resources such as ore, topsoil, sand, gravel, rock, gas, oil or any operations having similar characteristics. Said use includes the use of heavy equipment such as loaders, dozers, backhoes and crushers." Possible issues which could have impacts on the adjacent properties and the community are identified and conditions which could mitigate adverse impacts are proposed or explained: 1. Traffic impacts. The applicants route to and from the site is from the North, then along Exit Glacier Road, therefore a traffic control plan does not seem appropriate, as they will not be accessing lands within the City Limits. 2. Impacts to downstream properties mining or property rights for streamborne gravel, in the event that these rights exist. Since the permit only authorizes the activity, any downstream users concerns for acquisition of gravel which would flow downstream during high water events would need to be dealt with as a separate issue. 3. Impacts to stream flows. As a flood mitigation measure for the community, removing gravel from the Resurrection River is beneficial. The "no -rise" certificate issued by an engineer states that no adverse impacts to 1 percent (100 year) flood elevations, floodway elevations and floodway widths will occur because of this activity. 4. Public sanitation facilities. Although public sanitation facilities are not available, that can be mitigated by having portable latrines onsite. 5. Environmental contamination. Fuel for operations shall not be stored onsite. 6. Future impacts. Floodplain Development Permits are issued for a 1 year period. The applicant is required to submit a request for renewal of the permit each year; therefore it follows that the CUP 8 only be in place with a valid Floodplain Development Permit. Numerous work sessions were held during the previous 18 months in making the changes to SSC15.10.140, Definitions, Glenz noted. The proposed changes to the City Code had been submitted to the City Attorney for review. No members of the public had expressed concerns over any of the changes. Staff recommended approval. Numerous work sessions were held during the previous 18 months in making the changes and updates, Glenz noted. Glenz specifically explained the addition to the Land Uses Allowed permitting chickens and rabbits on certain smaller residential lots. Roach' noted the intention of the code change was to accommodate residents who had expressed an interest in allowing chickens on smaller lots within the City. Commissioner Heinrich questioned whether the provision that chickens and rabbits not be allowed on lots with more than two dwelling units was written as intended. Morgan said the intention to allow chickens should not be allowed at apartment complexes. Glenz suggested that the Commission put the resolution on the table, then move to amend the specific citation to limit chickens and rabbits to parcels with only one dwelling unit. Glenz also pointed out that other fowl are covered in another portion of the code, not in the portion specifically allowing chickens and rabbits on some smaller residential lots. Morgan added the reason chickens and rabbits were added, specifically, was because of public requests and interest. The code change required pens and enclosures, which was not previously addressed, she stated. Notice of public hearing being posted and published as required by law was noted and the public hearing was opened. There were no requests to be heard and the public hearing was closed. Motion (Morgan/Butts) Approve Resolution 2011 -10 Heinrich said he brought up the restriction on the number of dwelling units per parcel to make sure the chicken allowance was written as intended. Roach' asked Administration if a parcel with a home and a mother -in -law apartment counted as a duplex under the current City Code. Glenz stated the mother -in -law apartment did not change the property use to a duplex, unless rent is charged. The department attempts to thank all property owners who comply with requested code compliance complaints of the department and the public. In this case, the property owner had several derelict vehicles which were cleaned up. Several members of the public responded favorably to the cleanup effort, which involved the residential property near the corner of Third Avenue and Madison Street. Commission Comments Morgan said she was pleased with the passage of Resolution 2011 -09 and Resolution 2011- 10, which involved several months of work by the Commission and staff. Roach' thanked Commissioners and Administration for recent efforts. Roach' also mentioned public concern about illegal bunkhouses. She requested staff to explain crew housing and how bunkhouses are approved. Glenz said bunkhouses are an issue every summer. Bunkhouses are intended for workers, such as cannery employees or construction laborers, where sanitary facilities are shared with several rooms and there are no individual cooking facilities. A conditional use permit is required for bunkhouses, and they are only allowed in the Auto Commercial, Industrial and Institutional zoning districts. Glenz explained the problem was the use of larger houses in residential zoning districts. When several workers were housed in residential homes as roommates, neighbors often complain about the number of parked vehicles and other issues. Roach' said the bunkhouse issue was brought to her attention recently because a member of the public complained about a property with excess trash. Glenz said the department would like to talk with anyone who has concerns or information about illegal bunkhouses. Citizens' Comments Weston said that the Alaska State House and Senate Joint Transportation Committee would be visiting Seward on September 7. A multi- agency emergency exercise was also scheduled for the second week in August, Weston said. Work to refine the proposed changes to the Manual has been ongoing throughout this summer. Communities and others are encouraged to review the proposed changes (via the website, see below) and to make comments and suggestions. All comments received by August 31 will be forwarded to the CRS Task Force. The Task Force meets in September and at that time will formulate for FEMA its final recommendations on revisions to the CRS. More than 500 people participated in 15 two -hour "webinars" held during July and August to explain and discuss proposed new aspects of the Coordinator's Manual. Several of the webinars were hosted by CRS Users Groups and focused more closely on localized concerns. Two were devoted entirely to the revamped 300 series —the Public Information activities. Lots of questions were asked and answered, and all the comments will be forwarded to the CRS Task Force. The proposed refinements are the culmination of work by the CRS Task Force, FEMA, and many CRS stakeholders, who collaborated to review and evaluate the current program, pursuant to A Strategic Plan for the Community Rating System, 2008 -2013. The Strategic Plan was approved by FEMA in 2008 in order to guide the CRS Task Force in a multi -year evaluation of the CRS —the first complete evaluation since 1990. Five objectives were established in the Strategic Plan to move the CRS towards its goals (see box). In June 2011, the Task Force conducted a week -long "Weighting Forum" in Philadelphia. This involved all Task Force members, consultants, and 17 outside subject- matter experts. The Forum's recommendations are being used by FEMA and the Project Team to calculate points under the revised Manual. Input from Stakeholders The results of this process are being used to prepare the 2012 CRS Coordinator's Manual. Papers on the proposed changes have been publicized and are posted on the 2012 Manual website. In July and August, 15 webinars were conducted to explain the proposals and seek comments. They were attended by over 500 people from all over the country. The • comments will be collated and summarized for the September Task Force meeting. A New Manual Every activity in the Community Rating System will have some revisions in the 2012 CRS Coordinator's Manual in order to meet the goals and objectives of the Strategic Plan. Some major changes have necessitated reorganization of an activity and /or affect several different activities and associated elements. The 2012 Manual will be drafted during the fall and is anticipated to be released early in 2012. Specific points will be assigned to the various activities and elements after the September Task Force meeting. The next issue of the newsletter will provide information about the final points. Cape Coral Honors CRS Efforts Two staff members from the City of Cape Coral, Florida, Department of Community Development have been named "employees of the year" for their work to save homeowners $5.1 million on their National Flood Insurance Program policy rates, according to news - press.com. Richard Sosnowski, Comprehensive Planning Team Coordinator, and Lori Blydenburgh, Planning Technician, spent many months documenting the City's open space preservation, cumulative substantial improvement regulations, outreach projects, provision of information on flood protection of buildings, building codes, stormwater management, and other credited activities. Cape Coral is a CRS Class 5 community, earning a 25% reduction in the flood insurance premiums of its policyholders in the Special Flood Hazard Area. Between them, Sosnowski and Blydenburgh have about 35 years of experience with the City. "I was on the Cape Coral cycle visit last year because the city is one of the CRS's top 10 high - discount communities. Those two were impressive," said French Wetmore, a consultant to the CRS. "And they were fun to work with." A city of 150,000 people, Cape Coral lies along the southwest Florida coast. In October, Cape Coral will celebrate its 20th anniversary of participation in the CRS. NFIP /CRS Update ' • August — September 2011 28 Help with Open Space Easements Land within a community's jurisdiction that is preserved as open space can receive CRS credit under the OS (preserved open space) element of Activity 420 —Open Space Preservation. One credited way to protect such open space is with easements —legal contracts that allow one party to "use" the property of another for specified purposes. In the case of an open space easement, the owner of the land would relinquish development rights to the holder of the easement (the community, a nonprofit group, a government agency, or other entity) but would retain ownership and other rights, such as to farm, ranch, or enjoy "quiet use." The Natural Resources Conservation Service of the U.S. Department of Agriculture has a range of conservation easement programs that can provide technical and financial help to communities and their partners who are trying to protect and /or restore natural floodprone or watershed areas. For example, under the floodplain easement option of NRCS's Emergency Watershed Protection Program, a landowner voluntarily sells to the NRCS a permanent conservation easement that provides the NRCS with the authority to restore and enhance the floodplain's functions and values. The landowner can still use the property for recreation and other activities compatible with the protection of the natural open space. In August, ISO /CRS Specialists send each community a detailed list of the activities for which they are receiving CRS credit. Some of the more common trouble spots for communities are — Annual reports, including those done for a public information program strategy (OPS, Activity 330) and a mitigation or floodplain management plan (Activity 510). — Under Activity 330 (Outreach Projects), copies of all the projects sent out during the year, including additional projects (OPA), projects done pursuant to a public information program strategy (OPS), and a project to the repetitive loss area (see Section 503 of the Coordinator's Manual). -- Reports from the local emergency manager on the annual exercise or drill of the emergency response plan, lessons learned from implementing the plan in response to an emergency or disaster, and the updated list of critical facilities affected by flooding (Activity 610).
