CITY OF SEWARD, ALASKA RESOLUTION 2011 -074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, RESCINDING RESOLUTION 2011 -073, WHICH APPROVED AN EMPLOYMENT AGREEMENT WITH ERIC PHILLIPS FOR CITY MANAGER SERVICES WHEREAS, on City Manager Phillip Oates resigned effective September 30, 2011 and his resignation was accepted by the City Council by Resolution 2011-054; and WHEREAS, the Council advertised the position of City Manager for four weeks in July, and conducted public meetings and interviews to fill the position of City Manager; and WHEREAS, during its regular meeting on September 12, 2011 after an executive session, the Council voted unanimously to offer the position to Eric Phillips dependent on successful contract negotiations, a successful drug test, and a criminal background check; and WHEREAS, on September 26, 2011, the City Council unanimously approved Resolution 2011-073, which approved an amended contract with Eric Phillips; and WHEREAS, on September 29, 2011, Phillips verbally y told the Mayor he would not be able to accept the position; and WHEREAS, it is the wishes of the City Council to rescind this resolution to continue efforts in hiring the next City Manager. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Resolution 2011-073 is hereby rescinded. Section 2. To: Mayor and City Council u ;; 7; 9 0 From: Johanna Kinney, City Clerk( qt P Agenda Item: Rescind Resolution 2011 -073 BACKGROUND & JUSTIFICATION: Since City Manager Phillip Oates tendered his resignation, the City Council has been seeking applications for the position that recently became vacant on September 30, 2011. After a lengthy but quick search, Council selected Eric Phillips out of 40+ applicants, pending a successful drug and background check and successful contract negotiations. On September 26, 2011, Council approved Resolution 2011 -073 that approved the employment contract for Eric Phillips as the new City Manager. Unfortunately, Phillips relayed to Mayor Dunham three days later he would be unable to accept the position. Phillips had not yet signed the employment contract. INTENT: It is assumed the intent of the City Council would be to rescind Resolution 2011 -073, hereby repealing the employment offer to Eric Phillips, so as to move forward with the hiring of the next City Manager. CONSISTENCY CHECKLIST: Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures or Other Plans or Policies. NO FINANCIAL REVIEW REQUESTED. ATTORNEY REVIEW: Yes No X RECOMMENDATION: It is the recommendation of the City Clerk to rescind Resolution 2011 -073, which approved an employment contract with Eric Phillips. It further the recommended by the City Clerk for Council to discuss this evening what steps they would like to take next. Some options worth discussing may be: - -Hire an interim City Manager (note: will take at least another meeting to approve any type of employment contract) -- Appoint an Acting City Manager in house until an interim or permanent City Manager comes on board. - -Look at other applicants (council can go into executive session if they would like to discuss this)
