A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF
THE CITY OF SEWARD, ALASKA, RECOMMENDING KENAI
PENINSULA BOROUGH APPROVAL OF THE PRELIMINARY REPLAT
OF LOTS 1 AND 2, BLOCK 4, ORIGINAL TOWNSITE OF SEWARD, OLD
SOLLY'S REPLAT, CREATING ONE LOT TO BE KNOWN AS LOT 1A,
LOCATED AT 411 WASHINGTON STREET
WHEREAS, Cline and Associates Land Surveyors submitted a preliminary plat to the City
of Seward for review and recommendation to the Kenai Peninsula Borough; and
WHEREAS, this replat combines the two (2) existing lots - Lots 1 and 2, Block 4, Original
Townsite of Seward, into one (1) new lot to be known as Lot 1A; and
WHEREAS, Lot lA will consist of 2,756 square feet; and
WHEREAS, this parcel contains a single structure, constructed in 1911, which encroaches
into the public Right of Way on the North, South and West; and
WHEREAS, the City has reviewed these encroachments and is in the process of issuing an
encroachment permit; and
WHEREAS, the property is zoned Central Business District; and
WHEREAS, the property is currently serviced by municipal water, sewer, electric and other
utilities; therefore a subdivision installation agreement is not required for this replat.
• NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission recommends the Kenai Peninsula Borough approve the Seward
Original Townsite, Old Solly's Replat, combining Lots 1 and 2, Block 4, into one (1) new lot to be
known as Lot 1A, of approximately 2,756 square feet.

Agenda Item: Preliminary Plat Review of Lots 1 and 2, Block 4, Original Townsite
of Seward, Old Solly's Replat
BACKGROUND & JUSTIFICATION:
Attached for the Commission's review and recommendation to the Kenai Peninsula Borough
Planning Commission is a preliminary plat submitted by Cline and Associates. This replat will
combine two (2) originally platted lots, Lots 1 and 2, Block 4, Original Townsite of Seward, into
one lot to be known as Lot 1A. The proposed replat vacates one interior lot line creating a single
parcel of 2,756 square feet.
In accordance with Borough requirements, the City must review and comment on a platting
action before submittal to the Borough for final approval.
Zoning: The lots are currently zoned Central Business District -- which is consistent with the
Land Use Plan. SCC 15.05.025 (b) (9) Central business district (CBD). Provides for an area of
convenient, attractive, concentrated commercial development primarily intended for retail,
financial, entertainment and professional services occurring within enclosed structures.
Regulations applying to this zone are designed to encourage a compact group of businesses of
the type which are mutually beneficial and located close enough together to encourage walk -in
trade.
The parcels surrounding this replat are generally within the Central Business Zoning District. To
the south is the Historical Hoben Park, which is within the Park Zoning District. All other
parcels are within the Central Business District. Also to the south is the Historical Depot
Building and the Alaska SeaLife Center parking lot. To the west across the alley is a vacant lot,
which formally contained the Arcade Building. Across Washington to the north is the
"Legends" Building owned by the National Park Service. The area to the east contains the
Railway / Fifth Avenue intersection and the continuation of the SeaLife Center Parking lot.
Utilities: The property is served by the existing public utilities and maintained streets; therefore
a subdivision agreement is not required. There are appropriate fire hydrants within an approved
distance.

Size: The new lot will contain 2,756 square feet. The new lot will meet the requirement for
minimum lot width and buildable lot size for the Central Business District.
Existing Use: Currently the historic commercial structure, known as Old Solly's is built over
Lots 1 and 2. The historical structure was originally built around 1916 and is being rehabilitated
to house the Kenai Fjords National Park Service offices. The structure is of a unique design in
that it conforms to the trapezoidal lot plan. The structure encroaches into the public right -of -way
on three sides. The south side of the structure, second floor extends over the sidewalk into the
Railway Avenue public right -of -way. The north side of the building encroaches approximately
0.3 of a foot (3.6 inches) and the building entrance awning encroaches 4 feet over the sidewalk
into the Washington Street right -of -way. The west side of the structure encroaches
approximately 0.5 of a foot (6 inches) into the ally right -of -way. In 1965 Sol Urie granted the
City a 12.5 square foot "right -of -way and easement" on the East side of Lot 1 for the
construction, repair and replacement of public sidewalks and streets.
The City is currently in the process of granting encroachment permits for the above listed
encroachments.
Flood Zone: The property is not within a FEMA mapped Flood Hazard Zone.

Staff Comments
City department heads have reviewed this preliminary replat, and no concerns or comments were
submitted.
RECOMMENDATION:
Commission approve Resolution 2013 -06 recommending Kenai Peninsula Borough approval of
the preliminary replat of Lots 1 and 2, Block 4, Orginal Townsite of Seward, Old Solly's Replat,
creating one lot to be known as Lot 1A, located at 411 Washington Street.

Call to Order
The March 5, 2013 Regular Meeting of the Seward Planning & Zoning Commission was
called to order at 7:00 p.m. by Chair Roach'.
Opening Ceremony
Commissioner Fleming led the Pledge of Allegiance to the flag.

There were present:

comprising a quorum of the Commission; and

City Administration Report
City Planner Donna Glenz updated the Commission on the following business items:
• Glenz thanked the Seward / Bear Creek Flood Service Area Board and staff for recent work
that had been completed.
• Glenz said a proposed zoning change for a small portion of Waterfront Park had been
tabled by City Council. The proposal called for changing the zoning for a portion of Tract
G from Harbor Commercial to Park.
• Renovation of the Old Solly's Building was on schedule. The National Park Service
• planned to complete the project during summer.
• A demolition permit had been issued to remove the Alaska Vocational Technical Center
dormitory building on Third Avenue. A building permit for the new housing was to be
issued.
• The Historic Preservation Commission had requested a letter of Commission support for
updating the 1996 Historic Preservation Plan. The item was not on the meeting agenda, and
Glenz requested that the Commission add the item as "C" under New Business.
• Staff reminded Commissioner Fleming that she would provide the Planning & Zoning
Commission quarterly report to City Council at the March 26 Council meeting.
• The Kenai Peninsula Borough Assembly was scheduled to meet in Seward on April 16,
and the Commission would need to reschedule its work session for that evening or change
the location of the meeting.

• A City Council work session was scheduled for Wednesday, March 13 to review the 2012
International Building Code.
• The Seward Historic Preservation Commission was scheduled to hold a regular meeting on
Wednesday, March 13.
• Glenz introduced Alexis Campestre to Commissioners. Campestre had submitted an
application to serve on the Commission.
Ecklund asked Administration if the Old Solly's Building remodel was planned as an
energy efficient or "green" project.
Glenz said the structure would be as energy efficient as possible, but no alternate energy
sources were planned. Glenz said she did not know if the building materials were "green."
Fleming asked why the Waterfront Park rezone was tabled by City Council.
Glenz said the Council did not want to introduce a rezone that would change Harbor
Commercial property to the Park designation based on some concerns about future
development in the area.

Resolution 2013 -05 of the Planning and Zoning Commission of the City of
Seward, Alaska, recommending City Council Approval of the Planning and
Zoning Commission Priorities from April 2013 to April 2014
Glenz noted the history of the work sessions that Commissioners held to establish the
priorities for the coming year.
Motion (Ecklund/Butts) Approve Resolution 2013 - 05
Ecklund asked Glenz for direction regarding the ability to mandate action on the part of
City staff as it related to Item 3 on the Continuing priorities. The priority read, "Encourage
the City Manager to request an update of the Parks & Recreation Master Plan."
Glenz said the best course of action was to keep the priority list language as it was. Glenz
said she would express the Commission's concerns to Administration.

Ecklund asked if the Nash Road Bench Study was to be removed from the priorities for the
coming year.
Commissioners explained that the Bench Study was moved to the bottom of the list and
would be undertaken as funding allowed.
Ecklund asked if the priority of pursing City Code compliance had any time limit.
Roach' said the priority would be ongoing.

Direct staff to prepare a letter of support for the Historic Preservation Plan
update
Glenz explained that Historic Preservation Commission staff had drafted a grant to update
the Historic Preservation Plan. A letter of support was recently requested, and because of
that late request the item could not be included in the meeting packet.
Roach' asked about the nature of the grant and its amount.
Glenz did not know the amount of the grant, but said the funding may be used to hire a
consultant.
Ecklund asked who would receive the grant.
Glenz said the state Certified Local Government grant would be distributed to the Historic
Preservation Commission.
Commissioners further discussed the proposed letter of support for a Historic Preservation
Plan update.
Motion (Ecklund/McClure) Direct staff to prepare a letter of support
for the Historic Preservation Plan update
Ecklund asked if any members of the Commission had read the current Historic
Preservation Plan and how large the document was.
Roach' said the document was not as extensive as the Municipal Lands Management Plan.
Commissioners further discussed the proposed letter of support and the potential for a grant
award.

Quarterly Report to City Council Reminder
Commission Comments
Fleming said she would miss some of the upcoming public meetings, but planned to be
available for the March 26 quarterly report to City Council. Fleming said she would provide a
summary of the Commission's work for the quarter and rely upon meeting minutes. Fleming
agreed to contact staff prior to providing the report if any additional information was needed.
McClure thanked staff and Commission members for the recent work that had been
completed. McClure said he would be traveling and unavailable for the Planning & Zoning work
session on March 19.
Butts thanked Glenz for providing the history of events when needed. Butts also noted the
Region III high school basketball tournament that would be held in Seward starting March 7. He
also encouraged support of a planned March 30 fundraiser for the Seward Animal Shelter.
Ecklund said she was in favor of holding the April 16 Planning & Zoning Commission
work session in the new library building.
Roach' thanked staff for the meeting preparations and also thanked the new Commission
applicant, Alexis Campestre, for expressing interest in filling one of two vacancies on the
Commission. Roach' also said it would have been helpful if Historic Preservation Commission
staff had attended the meeting to answer some of the questions that arose during the discussion of
whether to provide a letter of support.

CRS Award for Excellence Nominations
The NFIP has established an award to recognize individuals who have actively advanced the vision of the NFIP and
the Community Rating System (CRS). The CRS is a program within the NFIP that provides guidelines for
participating communities that want to continually improve their community's safety and resilience to flooding and
other natural disasters.
While all CRS participating communities are taking steps that improve their flood safety and resilience, certain
communities stand out. As in all serious endeavors, outstanding results do not just happen. They are due to the efforts
of specific individuals, who through their knowledge, commitment and passion, have made their communities safer. In
an effort to recognize such individuals the NFIP is seeking nominations for the 2013 CRS Award for Excellence.
FEMA is asking for help in identifying worthy individuals. In particular, nominees who have provided leadership in
the area of alerting residents to the dangers of flooding and promoting the purchase of flood insurance through the
NFIP.
If you know of any such individuals, please help to recognize their achievements. Nominations are due by March 8,
2013.
