OPENING CEREMONY Police Chief Tom Clemons led the Pledge of Allegiance to the flag. ROLL CALL There were present: David Seaward presiding and Vanta Shafer Bob Valdatta Ristine Casagranda Marianna Keil comprising a quorum of the Council; and Dave Squires, Acting City Manager Johanna Kinney, City Clerk Brenda Ballou, Deputy City Clerk Absent — Bardarson, Terry CITIZEN COMMENTS ON ANY SUBJECT EXCEPT THOSE ITEMS SCHEDULED FOR PUBLIC HEARING - None APPROVAL OF AGENDA AND CONSENT AGENDA Motion (Keil /Shafer) Approval of Agenda and Consent Agenda Seaward added Resolution 2013 -028 to the consent agenda. Motion Passed Unanimous The clerk read the following approved consent agenda items: Approval of the March 11, 2013 and March 26, 2013 City Council Regular Meeting Minutes. Resolution 2013 -026, Adopting The Seward Port And Commerce Advisory Board (PACAB) Priorities From April 2013 To March 2014. Resolution 2013 -027, Authorizing Payment In The Amount Of $96,040.38 To Alcan Electrical And Engineering, Incorporated For The Emergency Construction Costs Performed In 2012 To Re- Energize Camelot Subdivision. City of Seward, Alaska City Council Minutes April 22, 2013 Volume 39, Page 119 Resolution 2013 -028, Approving An Amendment To An Engineering Contract With R & M Consultants In The Amount Of $209,580 For The Construction Management Of The D -Float Replacement Dock At The Seward Small Boat Harbor, And Appropriating Funds. Resolution 2013 -029, Approving Amendment #2 To The Employment Agreement With The City Clerk And Appropriating Funds. SPECIAL ORDERS, PRESENTATIONS AND REPORTS Proclamations & Awards The retirement of Spring Creek Correctional Center's Superintendent Craig Turnbull was recognized. Mitch Seavey was recognized as the the 2013 Iditarod Champion. A proclamation for Bear Awareness Month was accepted by Matt Grey. A proclamation was received by Erin Lemas for Lemonade Day. A proclamation for Super Saturday Clean -Up Day was accepted by Karin Sturdy. A proclamation was read for Terry's Tires Bike Rodeo Safety and the Police Department Open House. City Manager's Report, Acting City Manager Dave Squires stated the following purchase orders had been approved by the City Manager for between $10,000 and $50,000 since the last council meeting: 1) Kendall Ford, $25,828 for Police Car, as approved by Council; 2) Northwest Sales & Service, $13,000 for Mulching Head Installation (Electric), as reported to Council; and 3) R &M Steel, $150,414 for Partial Steel Building (Electric), as approved by Council. City Manager Jim Hunt and Assistant City Manager Ron Long were currently meeting with legislators in Washington, D.C. and would travel later this week to the Port Development Partnership Meeting in Seattle, Washington with members from the Seward Chamber of Commerce representatives and Vice Mayor Jean Bardarson. Library Museum Collections Coordinator Amy Carney resigned to move to Juneau as the new State Library, Archives and Museums Web Master. Carol Clausen Conant was hired as the Library Museum Aide, filling the half -time vacancy left when Tim Morrow accepted the full -time Library Museum Technician position. Staff and volunteers were working to get the museum exhibits in place and storage areas organized before the official opening on May 11, 2013. The mural entitled The Incredible Story created by Nicole Femster was being installed by Harmon Construction. The Library reported the following use statistics: City of Seward, Alaska City Council Minutes April 22, 2013 Volume 39, Page 120 lbw March 2012 March 2013 % Change Library Visits 4269 6157 + 31% Circulation 3851 4801 + 20% Computer Use 589 1033 + 43% Wireless (1 hour sessions) 228 439 + 48% Community Use /Programs 72 320 + 78% Museum Visits Grand Opening May 11 The Seward Volunteer Fire Department received notice of an award for the FY 2012 Assistance to Firefighters Grant through FEMA. The approved firefighter wellness project amount was $25,660, with the grant share of $24,337 and the city's share $1,283.00 for Phase 1. This grant award would be brought to council at the May 13, 2013 meeting for acceptance. The Alaska Department of Environmental Conservation (ADEC) conducted a stormwater permit compliance inspection on April 11, 2013, and no problems were found. Harbormaster Mack Funk, Hunt and Polar Seafoods Manager Bill Fejes met to discuss plans to improve the Seward Marine Industrial Center (SMIC). The Port And Commerce Advisory Board work session scheduled for April 17, 2013 was cancelled for lack of a quorum. A 20 -year lease with two 5 -year renewal options was delivered for review and execution to Raibow Fiberglass and Boat Repair, LLC, owner David Phillips for a small area at SMIC and would be brought to council for approval in May. The road out to the quarry at SMIC was opened. There were currently 8 major projects in various phases of development for Public Works: Lowell Point Canyon Water Tank Refurbishment; New North Water Tank; Sludge Pile Disposal; #4 Lift Station Refurbishment; Tank Roof at Gateway; Sludge Dredging at SMIC and Lowell Point Lagoons; and, Refurbishment of the old Library for the Electric and Community Development Departments. Mayoral Report, David Seaward thanked everyone for attending and watching on television. Other Reports, Announcements and Presentations PUBLIC HEARINGS Ordinance 2013 -004, Amending Seward City Code, Section 12.05.031, International Mechanical Code, Adopting The 2012 International Mechanical Code (IMC) Including Revisions. Notice of the public hearing being posted and published as required by law was noted and the public hearing was opened. Squires said adopting the 2012 code would bypass the 2009 code changes, and there were no local additions being proposed. ir. No one appeared to address the Council and the public hearing was closed. Council requested an additional public hearing be held at the May 13, 2013 meeting. Motion to Postpone Passed Unanimous Consent Ordinance 2013 -005, Amending Seward City Code, Section 12.0.11, International Building Code, Adopting The 2012 International Building Code (IBC) Including Revisions. Notice of the public hearing being posted and published as required by law was noted and the public hearing was opened. Squires said adopting the 2012 code would bypass the 2009 code already adopted by the State of Alaska. The proposed amendments would be the same regardless of whether council adopted the 2009 or 2012 code. No one appeared to address the Council and the public hearing was closed. Motion (Casagranda /Shafer) Enact Ordinance 2013 -005 j Motion to Postpone (Shafer/Keil) Postpone the Enactment of Ordinance 2013- 005 to the May 13, 2013 Meeting. Council requested an additional public hearing be held at the May 13, 2013 meeting. Motion to Postpone Passed Unanimous Consent Ordinance 2013 -006, Amending Seward City Code, Chapter 9.15, Health And Safety, Adopting The 2012 Edition Of The International Fire Code (IFC), Including Revisions. Notice of the public hearing being posted and published as required by law was noted and the public hearing was opened. Squires said this ordinance followed the adoption of the 2009 code, and minimal changes had been included for local code. He included a proposed amendment relating to test valves for sprinkler systems. No one appeared to address the Council and the public hearing was closed. Motion to Postpone Passed Unanimous Consent UNFINISHED BUSINESS - None NEW BUSINESS Ordinances for Introduction Ordinance 2013 -007, Amending Seward City Code, Section 12.05.021, Adopting The 2012 Edition Of The International Resident Code (IRC), Including Revisions. Motion (Shafer /Keil) Introduce Ordinance 2013 -007 Squires said this was the current residential code in the city. The 2012 edition of the code was what was being proposed. Because of state statute requirements, there would be three public hearings held between 60 and 180 days following the first public hearing. Keil was concerned that the public wouldn't have ample opportunity to speak and suggested that the summer season was too busy for people to attend. She requested the second public hearing be held in August, and delay the final public hearing until nearer to the 180 day limit. Squires said the 2006 code would remain in effect until this code was finalized and adopted. Motion Passed Unanimous Other New Business Direct City Clerk to send a formal invitation to the City of Obihiro, inviting a delegation to celebrate Seward's 110 Founding Anniversary. Council directed the City Clerk to send the letter inviting a delegation from Obihiro, Japan to celebrate Seward's Founder's Day 110 Anniversary in August, 2013. Memo confirming 2013 City of Seward Financial Disclosure Forms were received in a timely manner from the City Council, Planning & Zoning Commission and City Manager. ir.. City of Seward, Alaska City Council Minutes April 22, 2013 Volume 39, Page 123 COUNCIL COMMENTS Keil said she had consistently been a proponent of allowing temporary structures. Shafer sent her condolences to the victims of the bombing at the Boston Marathon. She thanked Bardarson, Hunt and Long for the work they did with the legislators in obtaining funding for the Seward Marine Industrial Center's expansion project. Valdatta asked citizens to be courteous and respect the property of others. Casagranda said Happy Earth Day and encouraged everyone to be grateful for what they had. Seaward thanked the public for providing input on tonight's ordinances, and thanked everyone for attending the meeting. CITIZEN COMMENTS Wolfgang Kurtz said he had been working for a while to get a radio station going in Seward, and so far had been successful in getting the AM running provisionally with the Federal Communications Commission. He was concerned that he was not getting cooperation from the translators in order to get the FM up and running, and told council he may need the city's support in the future. COUNCIL AND ADMINISTRATION RESPONSE TO CITIZEN COMMENTS Keil said the Community Health Center (CHC) would be holding a Community Town Hall Meeting on May 4, 2013 3:00 p.m. — 5:00 p.m. at the Seward Community Library Museum.
