Adjournment Planning and Zoning Commission Meeting Agenda January 7, 2014 2 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2014-01 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, RECOMMENDING THE KENAI PENINSULA BOROUGH APPROVAL OF THE INTERIOR LOT LINE VACATION PRELIMINARY REPLAT OF TRACT C AND LOTS 1 AND 2, BLOCK 1, LEIRER INDUSTRIAL SUBDIVISION, AVTEC SKILL CENTER REPLAT; CREATING ONE LOT TO BE KNOWN AS LOT 1A, LOCATED AT 1910 LEIRER ROAD, WITHIN THE INDUSTRIAL ZONING DISTRICT WHEREAS, Lounsbury & Associates, Inc., on behalf of property owner Steve Leirer, has submitted a preliminary plat for review and recommendation to the Kenai Peninsula Borough Platting Commission; and WHEREAS, this platting action vacates the interior lot lines of Tract C and Lots 1 and 2, Block 1, Leirer Industrial Subdivision, creating one parcel totaling approximately 3.6 acres; and WHEREAS, the property is located within the Industrial Zoning District (I); minimum lot size and width as required by City Code have been met; and WHEREAS, Lounsbury & Associates has submitted the preliminary plat to be known as Leirer-AVTEC Subdivision, Tract 1; and WHEREAS,the property owner has requested the replat title be amended to read"Leirer Industrial Subdivision, AVTEC Skill Center Replat, Lot 1A;" and WHEREAS, City staff have reviewed, commented and voiced no concerns with the Lot 1A, Leirer Subdivision Replat; and WHEREAS, the replat area is currently serviced by roads, municipal water, sewer, electric and other utilities; no subdivision installation agreement shall be required; and WHEREAS, as stated in Seward City Code §16.01.015(F), Conditions to plat approval, plats creating a single parcel through the vacation of interior lot lines shall not require public hearing; and WHEREAS, it is the Seward Planning and Zoning Commission's responsibility to act in an advisory capacity to the Kenai Peninsula Borough regarding subdivision plat proposals. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: 3 Seward Planning and Zoning Commission Resolution No. 2014-01 Page 2 Section 1. The Commission recommends Kenai Peninsula Borough approval of the Leirer Industrial Subdivision, AVTEC Skill Center Replat, Lot 1A, subject to the following conditions: 1. The title of the replat is changed to "Leirer Industrial Subdivision, AVTEC Skill Center Replat, Lot 1A." 2. Add a plat note as follows: "No permanent structure shall be constructed or placed within an easement which would interfere with the ability of the utility to use the easement." 3. Amend plat note 2 to include that the acceptance of the plat by the City of Seward does not constitute acceptance of any existing encroachments. Section 2. BACKGROUND & JUSTIFICATION: Attached for the Commission's review and recommendation to the Kenai Peninsula Borough Planning Commission is a preliminary plat submitted by Lounsbury and Associates, Inc. on behalf of Steve Leirer. In accordance with Borough Code no preliminary plat within the City limits may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior review of the City. This replat is located at the North end of the Leirer Industrial Subdivision, north and east of Alameda Street and Leirer Road. This platting action vacates the interior lot lines of Tract C, and Lots 1 and 2, Block 1, Leirer Industrial Subdivision, creating one large parcel to be known as Lot 1A, totaling approximately 3.66 acres. The new Lot 1A provides a single large parcel currently leased to the State of Alaska, AVTEC Skill Center. AVTEC has future plans to expand the vocational program and construct new facilities on this parcel. Seward City Code (SCC) §12.01.030 states that no building, except a single family residence, may be constructed across platted property lines. Therefore, AVTEC has requested the interior lot lines be vacated in preparation for the new construction. Alaska Skill Center Tract C-1 is located north of the proposed replat and is owned by the State of Alaska. The current AVTEC Skill Center structure is generally located on Tract C-1. The structure was expanded to the south in 1980. During that expansion the structure was built over the property line creating an encroachment onto the privately owned property now known as the Leirer Subdivision. The matter of the encroachment is between the State of Alaska and the property owner, Steve Leirer. The State of Alaska, AVTEC has been leasing the property containing the encroachment (current Tract C) and the adjoining two (2) parcels (current Lots 1&2) and plans to continue the lease as well as invest heavily in additional structures on the leased area. The Borough subdivision code requires a plat note that clarifies that Borough acceptance of the plat does not constitute acceptance of any encroachments. Staff is requesting the City of Seward also be added to that plat note. 5 Seward Planning and Zoning Commission Agenda Statement—Resolution 2014-01 Page 2 of 2 SUBDIVISION REVIEW: Zonin : The replat is within the Industrial Zoning District. Development surrounding this replat includes the Alaska Railroad (ARRC) to the North and East, the ARRC tracks and the Seward Highway to the West and industrial developed properties to the South. Utilities: The replat area is currently serviced by plated Rights of Way, municipal water, sewer, electric and other utilities; no subdivision installation agreement shall be required. ExistinM Uses: The AVTEC wind generation facility is located on the current Lots 1 and 2. A portion of the existing Skill Center is located on the current Tract C. Flood Zone: The area is not within a mapped flood hazard area. The apartments could be allowed by Conditional Use Permit, but no permit had ever been issued. The rentals had been operated since sometime after 2004, Glenz said. Property owners were informed of the Conditional .0 se Permit,.application and no comments had been received, Glenz said. Fleming asked how an operator might learn that a Conditional Use Permit was required. Glenz said that normally a detailed City building permit application would be submitted and the Community Development Department would conduct..,a review for allowed uses and zoning and require the permit. During 2004,the review process'and building permit process was not as thorough,Glenz said. Butts asked if the rental property had been inspected:by the Fire Department. Glenz said the property would be inspected if it were used as a nightly rental operation, instead of monthly rentals.
