RESOLUTION 2014-01
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA,
RECOMMENDING THE KENAI PENINSULA BOROUGH APPROVAL
OF THE INTERIOR LOT LINE VACATION PRELIMINARY REPLAT
OF TRACT C AND LOTS 1 AND 2, BLOCK 1, LEIRER INDUSTRIAL
SUBDIVISION, AVTEC REPLAT; CREATING ONE LOT TO BE
KNOWN AS LOT 1A, LOCATED AT 1910 LEIRER ROAD, WITHIN THE
INDUSTRIAL ZONING DISTRICT
WHEREAS, Lounsbury & Associates, Inc., on behalf of property owner Steve Leirer,
has submitted a preliminary plat for review and recommendation to the Kenai Peninsula Borough
Platting Commission; and
WHEREAS, this platting action vacates the interior lot lines of Tract C and Lots 1 and 2,
Block 1, Leirer Industrial Subdivision, creating one parcel totaling approximately 3.6 acres; and
WHEREAS, the property is located within the Industrial Zoning District (I); minimum
lot size and width as required by City Code have been met; and
WHEREAS, Lounsbury & Associates has submitted the preliminary plat to be known as
Leirer-AVTEC Subdivision, Tract 1; and
WHEREAS, the property owner has requested the replat title be amended to read "Leirer
Industrial Subdivision, AVTEC Replat, Lot 1A;" and
WHEREAS, City staff have reviewed, commented and voiced no concerns with the Lot
1A, Leirer Subdivision Replat; and
WHEREAS, the replat area is currently serviced by roads, municipal water, sewer,
electric and other utilities; no subdivision installation agreement shall be required; and
WHEREAS, as stated in Seward City Code §16.01.015(F), Conditions to plat approval,
plats creating a single parcel through the vacation of interior lot lines shall not require public
hearing; and
WHEREAS, it is the Seward Planning and Zoning Commission's responsibility to act in
an advisory capacity to the Kenai Peninsula Borough regarding subdivision plat proposals.
L. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that

Section 1. The Commission recommends Kenai Peninsula Borough approval of the
Leirer Industrial Subdivision, AVTEC Replat, Lot 1A, subject to the following conditions:
1. The title of the replat is changed to "Leirer Industrial Subdivision, AVTEC
Rep lat, Lot 1A."
2. Add a plat note as follows: "No permanent structure shall be constructed or
placed within an easement which would interfere with the ability of the utility to use the
easement."
3. Amend plat note 2 to include that the acceptance of the plat by the City of
Seward does not constitute acceptance of any existing encroachments.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th
day of January 2014.
