HomeMy WebLinkAboutRes2015-004 Sponsored by: Applicant CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2015-04 RESOLUTION 2015-04 OF THE SEWARD PLANNING AND ZONING COMMISSION, RECOMMENDING KENAI PENINSULA BOROUGH APPROVAL OF LOT 28B, BLOCK 12, ORIGINAL TOWNSITE OF SEWARD,WELLS REPLAT,AT 210 BROWNELL STREET WHEREAS,Integrity Surveys Inc.has submitted a preliminary plat to the City of Seward for review and recommendation to the Kenai Peninsula Borough; and WHEREAS,the subdivision replat vacates the interior lot line of Lots 26A and 28A,Block 12, Original Townsite of Seward,and creates a single parcel to be known as Lot 28B,consisting of 12,600 square feet; and WHEREAS,the properties of this replat are located within the Urban Residential Zoning District(UR) and exceed the minimum lot size and lot width as required by City Code; and WHEREAS,the property abuts the 20 foot Right of Way known as Brownell Street and is currently serviced by municipal water, sewer, electric and other utilities; therefore a subdivision installation agreement is not required for this replat. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission recommends the Kenai Peninsula Borough approve the Lot 28B, Block 12, Seward Original Townsite, Wells Replat vacating the interior lot line of Lots 26A and 28A,Block 12,creating a single parcel of approximately 12,600 square feet subject to the following conditions: - A. Show the 15 foot utility easement abutting the Brownell Street Right of Way granted bythis plat(Note 2). B. Remove Notes 5 and 6,they have nothing to do with this plat. C. Change Note 1 to read"Development within this subdivision is subject to the City of Seward Land Use and Zoning regulations." Seward Planning and Zoning Commission Resolution No. 2015-04 Page 2 of 2 D. Add the standard utility easement note: "No permanent structure maybe constructed or placed within a utility easement which would interfere with the ability of the Utility to use the easement." E. Correct the Title Block to add Block 12. • F. Correct the Title Bock to Township 1 South Section 2. This resolution shall take effect immediately upon its adoption.
