HomeMy WebLinkAboutRes2004-018 I I I Sponsored by: Shealy CITY OF SEWARD, ALASKA RESOLUTION 2004-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE GARBAGE TARIFF WHEREAS, a proposition was placed before the qualified voters of the City at a regnlar municipal election held on October 3, 2000, and the voters approved a franchise agreement for the collection and disposal of garbage and refuse between the City of Seward and Peninsula Sanitation Company, Inc. ("Peninsula Sanitation"); and WHEREAS, the City and Peninsula Sanitation entered into a contract on November 20, 2000 which extends through December 31,2005 with an option to extend for an additional five years; and WHEREAS, the current garbage tariff was adopted by Council according to Resolution 2000-085 and has not been adjusted since January 1, 2001; and WHEREAS, the contract authorizes Peninsula Sanitation to submit a written request to the City, along with sufficient data on projected revenues and expenses to support its request for an adjustment to the rates, and Peninsula Sanitation submitted such information to the City Council at a work session held on January 26,2004; and WHEREAS, Peninsula Sanitation is requesting an upward adjustment of8% to all garbage rates in order to offset a minor portion of the increase in the consumer price index, increases in insurance and storage costs, and such rates will now be reflected in "Exhibit 2 - Amendment No.1" of the Contractual Agreement for the Collection and Disposal of Garbage, Rubbish and Waste Material in the City of Seward, Alaska. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Effective April 1 , 2004, the City of Seward garbage/refuse rates and charges as set forth in the Utility Tariff are deleted and replaced with the rates and charges attached hereto and incorporated herein by reference. Section 2. Effective Aprill, 2004, the rates and charges schedule attached hereto as "Exhibit 2 - Amendment No.1" replaces "Exhibit 2"of the Contractual Agreement for the Collection and Disposal of Garbage, Rubbish and Waste Material in the City of Seward, Alaska, dated November 20, 2000. Section 3. This resolution shall take effect ten days following adoption and posting. The rate increase shall take effect on April 1, 2004.
