CITY OF SEWARD, ALASKA
RESOLUTION 2016-071
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING A FACILITY USE AGREEMENT WITH
ALASKA'S INSTITUTE OF TECHNOLOGY (AVTEC), PROVIDING
ACCESS FOR PUBLIC RECREATION AT AVTEC'S STUDENT SERVICE
CENTER
WHEREAS, the Seward City Council seeks to improve public health and recreation
opportunities; and
WHEREAS, the community has enjoyed the benefits of access to AVTEC's indoor
recreation facilities for over three decades, and the public has expressed a strong need to continue
indoor recreation; and
WHEREAS, the City's Parks and Recreation Department's Sports and Recreation division
budget is currently funded to provide staffing, supplies and programs to AVTEC students, employees
and members of the public; and
WHEREAS, it is in the public's and the City of Seward's best interest to enter into this
agreement with AVTEC.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Seward City Council hereby authorizes the attached Facility Use Agreement
between the City of Seward and AVTEC through June 30, 2019.
Section 2. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 24'h
day of October, 2016.

Agenda Item: Use Agreement between AVTEC and City of Seward
BACKGROUND & JUSTIFICATION:
The community and the City of Seward has long enjoyed the benefits of providing community
recreation programs through the AVTEC (Gym) Student Service Center (SSC) to the public. The
following, new Use Agreement offers several amendments and is recommended by
Administration for approval. The City attorney reviewed this Use Agreement last week.
The attached three-year Use Agreement includes one three-year extension option, to be
authorized by the City Manager if no major changes are proposed, and includes the opportunity
for minor rate adjustments based on actual costs in the interim. The financial impacts of the Use
Agreement remain fairly constant. They reflect a change in billing modes from a per month
option to a per -day option, which allows more fluid changes, based on use. The City of Seward
will no longer contract custodial care. AVTEC has included those estimated costs in the
discounted daily rate. Rent payments will be made directly to AVTEC. The new Use Agreement
allows flexible hours to the public with increased opportunities to use all of the weight room
programs along with locker rooms, showers, racquetball court, gym and office space. The sauna
will be made available, too, however at a reduced time compared with previous years.
INTENT:
The intent of this agreement is to provide accessible and quality recreation to members of the public
who may not otherwise be provided access to indoor recreational opportunities. It is equally
beneficial to have parks aid recreation programs available to AVTEC students and their families
who are (temporarily) living in Seward. It is understood the costs of recreation space is a needed
expense, and this partnership brings increased value to users and the general tax payer by sharing
facilities. The agreement offers the City maximum flexibility in determining the desired number of
days' of facility use. The daily use fee is considered to cover all costs including facility rental,
utilities, custodial supplies and custodial services. The fee also includes office "window space" in
months where the City has scheduled a minimum of 10 days' of usage.

FISCAL NOTE:
The 2016 and 2017 budget included the custodial contract and AVTEC rent budgets, which will
now be consolidated into AVTEC rent/lease. Parks and recreation staff will schedule public
recreation in strict adherence to the existing 1420 personnel budgets, and the new use agreement
is not expected to require a budget amendment.
