Adjournment Planning and Zoning Commission Meeting Agenda May 2, 2017 2 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2017-07 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO BWRR, LLC dba TEMPLE STUDIOS FOR AN ARTS EDUCATION CENTER SCHOOL AT 417 FIFTH AVENUE, WITHIN THE OFFICE RESIDENTIAL ZONING DISTRICT WHEREAS, BWRR, LLC dba Temple Studios has proposed operating an arts education center at 417 Fifth Avenue and has undertaken necessary improvements to the existing commercial structure, meeting Building Code requirements for that occupancy; and WHEREAS, Temple Studios has applied for a Conditional Use Permit from the Seward Planning and Zoning Commission for the proposed school, which is to be located on approximately 12,000 square feet within the Office Residential Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, a school, private is allowed in the Office Residential Zoning District as a conditionally permitted use; and WHEREAS, the new school will contribute to addressing the educational needs of the community and provide commercial instruction in such activities as music and arts to students of all ages; and WHEREAS, having complied with the public notification process; on May 2, 2017, the Seward Planning and Zoning Commission held the required public hearing on the Conditional Use Permit application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC 15.10.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter(the Seward Zoning Code) and the purposes of the zoning district. Finding: The property is zoned Office Residential (OR) and is intended to 3 Seward Planning and Zoning Commission Resolution No. 2017-07 Page 2 provide for medium density residential, commercial and office development designed to act as a transition zone between the high density central business district and surrounding medium-high density residential districts. A private arts school is allowed in the Office Residential district by conditional use permit from the Planning and Zoning Commission and no adverse impacts to adjoining properties are anticipated, other than an increase in parking. The applicant has • provided agreements of understanding from Sacred Heart Catholic Church and the commercial property operated by dentist Michael P. Moriarty to provide overflow parking, as needed. B. The value of adjoining property will not be significantly impaired Finding: This condition has been met. There is no indication that the improvement to the structure will negatively impact the value of adjoining properties and no negative public comment has been received from the neighboring property owners. C. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: The proposal is in harmony with the Seward Comprehensive Plan and Strategic Plan in that both plans address needs for developing and integrating educational facilities or programs. Seward 2020 Comprehensive Plan The Comprehensive Plan has a goal of supporting efforts to continually improve the quality of educational facilities located in Seward and ensuring that these facilities continue to enhance the community. Goals include the continued effort to "support quality after-school education programs," and support "art and music programs at the middle school level."(page 12). Strategic Plan(1999) The Strategic Plan emphasizes expanding and integrating educational programs (page 18). In addition, the community wished to provide diverse, year-round, indoor and outdoor recreational, educational, and cultural opportunities and facilities for residents and visitors of all ages and socioeconomic backgrounds. (page 12). D. Public Services and facilities are adequate to serve the proposed use. Finding: Water, sewer, and power will be available to the property as well as adequate fire,police and solid waste disposal services. E. The proposed use will not be harmful to the public safety, health or welfare. 4 Seward Planning and Zoning Commission Resolution No. 2017-07 Page 3 Finding: The proposed school may increase parking demand, particularly during recitals and performances. The parking, as noted, will accommodate additional spaces for special events. The previously adopted parking plan for the former Elk's Club included adequate spaces for normal club use and events. F. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. The required parking shall be provided in accordance with Seward City Code Section 15.10.215 Parking. 2. Adequate trash containers are to be located at the building entrance, alley or other locations as needed and approved by staff. 3. The applicant is encouraged to continue to work with the neighboring property owners to mitigate traffic impacts in the alley and street. 4. Modification of final approval of a conditional use permit may, upon application by the permittee, be modified by the Planning and Zoning Commission: a. When changed conditions cause the conditional use to no longer conform to the standards for its approval. b. To implement a different development plan conforming to the standards for its approval. c. The modification plan shall be subject to a public hearing and a filing fee set by City Council Resolution. Section 2. The Planning and Zoning Commission finds that the proposed use, subject to the above conditions satisfies the criteria for granting a Conditional Use Permit provided the conditions listed on Section 1, Subsection F. are met by the applicant, and authorizes the administration to issue a Conditional Use Permit for the School, Private (Arts Education Center) within the commercial building located at 417 Fifth Avenue, located within the Office Residential Zoning District. 5 Seward Planning and Zoning Commission Resolution No. 2017-07 Page 4 Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320; Conditional Use Permits, and authorizes the administration to issue a Conditional Use Permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. This resolution shall take effect 10 days following its adoption. The property is owned by Tyson Davis, and was formerly owned by the Seward Temple Corporation (Masons) and had been used for their activities for many years. Another use was as an Elks Lodge and prior to that, the 4,500 square foot structure housed an early childhood development (Head Start) program. The applicant has proposed to provide small classes and workshops for all ages. The applicant plans to support community engagement programs that promote positive adult- youth relationships, and classes would range from dance and writing to music and yoga. A "School, public/private" is allowed via Conditional Use Permit (CUP) in the Office Residential (OR) Zoning District, as per Seward City Code (SCC) Land Uses Allowed Table 15.10.225. The intent of the Office Residential Zoning District is as follows: SCC 15.050.025, Land Use Districts -- Established, Definitions, (6), "Office/Residential district (OR). Intended to provide for medium density residential, commercial and office development designed to act as a transition zone between the high density central business district and surrounding medium-high density residential districts." At the time of publication of this report, staff had received no public comment. SURROUNDING LAND USE AND ZONING: 7 The surrounding area features professional offices, apartments, residential structures some of which have professional offices, the Catholic Church is on the property to the South and the American Legion is to the East across Fifth Avenue. Floodplain status: According to the FEMA Flood Insurance Rate Map, this property is not located in a special flood hazard area. Utilities: The property is served by existing public utilities. The developer will continue to work with staff, through the building permit process to address development needs. Adequate fire, police and trash services are available. Parking: Seward City Code§15.10.215 Parking, requires that one (1) parking space for every four seats. The maximum capacity is approximately 100, and the applicant has secured overflow parking at the Sacred Heart Catholic Church and the nearby dentist office. The Elks Club that previously operated at the location had provided 14 spaces, without the benefit of a the entire front yard area due to fencing. Sacred Heart Parish celebrates Mass on the weekends at 5:30 p.m. on Saturday and 9:30 a.m. on Sunday. Our weekday Masses are from Tuesday through Friday at noon. There are other times, such as Christmas and Holy Week(this year from April 9- 16)where we utilize the parking lot extensively during the evening hours and we request that you respect those times by not utilizing the parking lot to the detriment of our parishioners. On Saturday,we use the parking lot from about 5 p.m. until 7 p.m. and on Sunday mornings from 9 a.m. until about 11 a.m. There is no parking here at Sacred Heart on the Fourth of July as we hold our annual Chicken Barbecue in the parking lot. Special uses of the lot include Friday evenings during Lent from about 5 p.m. until 7:30 p.m.,Holy Thursday evening, Good Friday afternoon and evening until approximately 9 p.m. and Holy Saturday evening until midnight. Frye 417 5th Avenue Seward, AK 99664 RE: Temple Studios Parking Permit Dear J.W., We are excited for Temple Studios to join our neighborhood and as a good neighbor, do not mind if your customers park in our parking lot after hours and on weekends when we are not using it. Our hours are usually Monday-Thursday 8 a.m. —5 p.m. and Fridays from 8 a.m.to 3 p.m. Business staff usually depart within an hour after closing and one sanitation employee comes in at her leisure between closing and opening the next day. Dr. Moriarty, on occasion, will see emergency patients after hours including weekends. Specialists that rent our facility monthly will have priority on any conflicting days. To alleviate any conflicts, I suggest we keep the lines of communication open and that Sacred Heart's lot be the priority overflow lot prior to ours. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. In accordance with SCC § 15.10.320 (D), the Planning and Zoning Commission has reviewed the applicant's request for a CUP to operate a Campground, Camper/RV Park within the Industrial Zoning District at 1823 Nash Road, and made the following Findings of Fact: 19 Seward Planning and Zoning Commission Resolution No. 2017-08 Page 2 of 4 1. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition has been met. The property is located within the Industrial Zoning District (I). Campground, Camper/RV Park is allowed in the Industrial Zoning District by Conditional Use Permit. The Industrial Zoning District provides an area to accommodate business as the principal land use. Operation of a Campground, Camper/RV Park is consistent with parking and other land uses in the Industrial Zone. 2. The value of adjoining property will not be significantly impaired. Finding: This condition has been met or shall be through the conditions. The neighboring properties are largely wooded and/or undeveloped. There is no indication the requested Campground, Camper/RV Park will negatively impact the value of any of adjoining properties. 3. The proposed use is in harmony with the Seward Comprehensive Plan. Finding: This Condition has been met. The proposal is in harmony with the Seward 2020 Comprehensive Plan and Strategic Plan in that both plans encourage the growth of business. 4. Public Services and facilities are adequate to serve the proposed use. Finding: This condition shall be met through the conditions required. No public water or sewer is available to this site. The applicant shall be required to meet the City Code requirements of Title 8.15, Article 3, Permits and Article 4 Camper Parks, which address water and sanitary facilities. 5. The proposed use will not be harmful to the public safety, health or welfare. Finding: This condition has been met or shall be through the conditions. There is no evidence that a Campground, Camper/RV Park within the proposed location will cause any additional concerns to public safety, health or welfare. Adequate fire, police and solid waste disposal services are available to the property. Bear resistant trash receptacles are available and required by the conditions. The applicant shall be required to obtain an annual Seward business license and permit, which requires an annual life safety inspection of the area. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Based on the above findings and conclusions, approval of the CUP shall be subject to the following conditions: 1. The applicant shall maintain a current City Business License and annual Camper Park permit, to include the annual life safety inspection. 20 Seward Planning and Zoning Commission Resolution No. 2017-08 Page 3 of 4 2. The applicant shall demonstrate through the permit application how the conditions required in Title 8.15, Article 3, Permits and Article 4 Camper Parks are being met. 3. Animal / bird resistant dumpsters / containers shall be provided for all garbage and refuse for the life of the use. These containers shall be kept closed and emptied on regular basis to minimize the possible wildlife encounters. 4. Provide education information on wildlife safety, to include the storage of food and retention and disposal of fish and fish waste. 5. The applicant shall continue to work with staff through the Camper Park Permit process to address and accomplish any required upgrades to the public utilities if needed. 6. The applicant shall comply with the Utility Tariff as established by Council for private campground operators. The applicant shall maintain sufficient records to compute required payments. Records shall be made available to the City of Seward upon request. 7. The Planning and Zoning Commission may modify this conditional use permit if changed uses no longer conform to the standards and legal requirements justifying its present approval, or if the permittee applies for a modification to meet a different development plan that conforms to the standards and legal requirements for approval of a conditional use permit. 8. Any proposed modification plan shall be subject to the public notice and public hearing requirements of law, which shall occur only after payment of the filing fee established by resolution of the city council. Section 2. The Planning and Zoning Commission further fords the proposed use, subject to the above conditions satisfies the criteria for granting a conditional use permit provided the conditions listed in Section 1, Subsection 6 are met by the applicant, and authorizes the administration to issue a conditional use permit to Tim McDonald, to operate a Campground, Camper/RV Park within the Industrial Zoning District at 1823 Nash Road. Section 3. The Planning and Zoning Commission further fmds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320; Conditional Use Permits, and authorizes the administration to issue a conditional use permit. Additionally, the administration shall periodically confirm the use conforms to the standards of its approval. Section 4. The proposed campground is to be located on level and graded portions of the parcel that have served as parking in recent years. The area to be used for camping and parking and off-season storage is approximately eight (8) acres. The property has for years provided an access point for seasonal sport fishing within the Resurrection River and Resurrection Bay shoreline. Concerns for life safety from wildlife shall be addressed through the education of the campers by the applicant. SURROUNDING LAND USE AND ZONING: The parcel is within the Industrial Zoning District. The surrounding area to the west and south is vacant river drainage and tidelands. The areas to the east and north include privately owned parcels of minimal development. Floodplain status: According to the FEMA Flood Insurance Rate Map, adopted by the City of Seward, portion of the property being dedicated to camping is largely outside of the mapped special flood hazard area. Utilities: No public water or sewer is available to this site. The applicant is required by the conditions of the CUP to meet the City Code requirements of Title 8.15, Article 4 Camper Parks, which address water and sanitary facilities. The applicant has indicated an RV dump station and potable water service is available.
