Adjournment Planning and Zoning Commission Meeting Agenda July 18, 2017 Sponsored by: Applicant CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2017-09 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION, OF THE CITY OF SEWARD, ALASKA RECOMMENDING THE KENAI PENINSULA BOROUGH APPROVAL OF THE FEDERAL ADDITION, KANG REPLAT NUMBER 2; THIS REPLAT SUBDIVIDES ONE (1) LOT INTO TWO (2) SMALLER LOTS; LOCATED AT 810 SECOND AVENUE, WITHIN THE SINGLE FAMILY ZONING DISTRICT WHEREAS, Integrity Surveys, Inc., on behalf of property own Soo Kang, has submitted for review and recommendation to the Kenai Peninsula Borough a preliminary replat of Lot 7A, Block 14, Federal Addition to Seward, 2017 Addition, (Kang Replat No. 2); and WHEREAS, the parent plat is the original 1915 Federal Addition to Seward, the first replat of this property in 2011 was titled Federal Addition to Seward, Kang Replat; staff recommends the title be consistent in following the previous replat and therefore be changed to delete the "2017 Addition" and replace with "Kang Replat No. 2; and WHEREAS, this platting action will subdivide the current Lot 7A into two (2) smaller lots to be known as Lots 7B and SB, each approximately 5,000 square feet; and WHEREAS, the current lot contains a single family home, also being used as a Bed and Breakfast; and WHEREAS, the area included within this replat is currently zoned Single Family Residential (R1), based on the As -Built provided by the surveyor this replat does not create any non -conforming structures or lots within the current zoning district; and WHEREAS, City department heads have reviewed and have no comment regarding the proposed Kang Replat. No. 2; and WHEREAS, as required by Seward City Code § 16.01.015(A) Conditions to Plat Approval, and § 16.05.010 Required Public Improvements; the property is currently serviced by municipal water, sewer, electric and other utilities therefore no subdivision agreement is required; and WHEREAS, as required by Seward City Code § 16.01.015(B), Conditions to Plat Approval, property owners within 300 feet of the requested replat were notified of the proposed subdivision, and the property was posted with public notice signage; and Seward Planning and Zoning Commission Resolution 2017-09 Page 2 of 2 WHEREAS, it is the Planning and Zoning Commission's responsibility to act in an advisory capacity to the Kenai Peninsula Borough regarding subdivision plat proposals. This platting action is a replat of Lot 7A, Block 14, Federal Addition to the Seward Townsite, creating two (2) lots to be known as Lots 7B and 8B, Federal Addition, each new lot containing approximately 5,000 square feet. The replat is located at 810 Second Avenue on the southeast corner of Second and C Street, within the Single Family Zoning District. The parent plat is the original 1915 Federal Addition to Seward, the first replat of this property in 2011 was titled Federal Addition to Seward, Kang Replat. The surveyor has suggested a title that does not follow; therefor the staff recommends the title be consistent in following the previous replat and therefore be changed to delete the "2017 Addition" and replace with "Kang Replat No. 2. Seward City Code 15.10.220 Development Requirements were amended by City Council in January 2017 to allow the replatting of lots containing less than 6,000 square feet. This replat will require an exception to Kenai Peninsula Borough Subdivision Code. SUBDIVISION REVIEW: Zoning: This replat is located within the Single Family Zoning District. Properties to the north and south are also zoned Single Family. Parcels to the east across the ally are zoned Auto Commercial and parcels to the West across Second Avenue are zoned Institutional, Park and Urban Residential. Utilities: The property is served by the existing public utilities and maintained streets, therefore a subdivision agreement is not required. Existing water, sewer and electric lines are located in the adjacent rights -of -way. There are several fire hydrants within an approved distance. The lot to the south to be known at Lot 8B is undeveloped and being used as garden and landscaping for the single family home. The owner has expressed she would like to sell and or develop the lot to the south for a single family home. Flood Zone: The area is not located within a Special Flood Hazard Area. In accordance with Seward City Code (SCC) 16.01.015(B) "No preliminary plat of City -owned property may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior consent of the City." This replat is located within the Seward Marine Industrial Center (SMIC). This platting action subdivides Lot 3, Block 4, Fourth of July Creek Subdivision, SMIC, Raibow Replat creating two (2) parcels to be known as Lot 3A and the new Lot 4, Block 4, involving approximately 11.850 acres. The new Lot 4 will be under a long-term lease to Exit Marine. When the platting action is completed the lease agreement with Exit Marine will be brought before the Council for approval. SUBDIVISION REVIEW Zoning: The replat is within the Industrial Zoning District. Current development surrounding this replat includes the Vigor Industrial, Communications North and the City boat storage yard parcels. Attendance at all meetings and work sessions is extremely important. The procedure for Attendance and Excused Absences is outlined in the Planning and Zoning Rules of Procedure, Rule 14. (see below) RULE 14. ATTENDANCE AND EXCUSED ABSENCES. (a) A commissioner may be excused from attending a meeting of the Commission by notifying the chair or the administrative official prior to the meeting, and by stating the reason for his or her inability to attend the meeting. During the call of the roll at the meeting, the chair or the administrative official will announce that the absent commissioner is excused by prior notice of absence, and if no commissioner questions the absence the administrative official will crake an appropriate notation in the minutes. (b) If any commissioner questions the excused absence of another commissioner, the chair or the administrative official will recite the reason for the absence as reported earlier by the absent commissioner, and the chair then will entertain a motion to excuse the absent commissioner. This motion is non -debatable. Upon passage of this motion by a majority of the commissioners present, the absent member will be considered excused and the administrative official will make an appropriate notation in the minutes. (c) Following a member's absence from three consecutive regular meetings of the commission, excused or unexcused, the remaining commission members shall decide whether the commissioner should be retained or whether to request City Council appointment of a new commissioner. (d) The Council may remove members of boards regardless of term of office. The person so removed from office shall have the right to public hearing before the Council concerning the cause for removal. Unanimous Consent A body can approve motions by unanimous consent, otherwise known as general consent. Instead of calling for a roll call vote (or a voice vote — calling out each member's name), the presiding officer or a member of council can request the agenda item be approved by unanimous consent. This means individuals are not called upon to vote, and the entire body is consenting to the same affirmative position. Some things that should happen if unanimous consent is used: • The chair/presiding officer should always ask if there is any objection to voting by unanimous consent. • If there is My single objection to a vote by unanimous consent, the chair should put the motion to a vote. It only takes one person to object, and this is to ensure no rights are being violated. Please find below an update on recent SBCFSA activities, including cooperative mitigation projects with the City of Seward.. a, Since 2010, the service area has been working with the U.S. Army Corps of Engineers to complete a Section 205 Flood Risk Management project at the top of Salmon Creek. The project tears has finalized design specifications and drawings for a 1,675 foot long armored revetment to replace the gravel embankment. Alaska State Department of Natural Resources has issued an entry authorization for easements for an access road to the project site and a recreational parking area at the end of Romack Court in the Bear Lake neighborhood. With assistance from State grants, SBCFSA has funded over $1.4 million for the feasibility study, design, and implementation phases of this $4 million project. The contract is expected to be awarded July 318, with construction to begin in September of this year. b. Metco has completed bedload removal from Lost Creek in the Old Mill subdivision and an armored finger dike between the confluence of Lost and Grouse Creeks. Over 6,000 cubic yards of material was removed upstream and downstream of the Forest Road Bridge and taken to an upland location on Timber Lane Drive. The service area appropriated $30,000 from fund balance for the project and the Kenai Peninsula Borough (KPB) Roads service area provided $6,000 for work in the bridge right-of-way. c. CIC, Inc. completed restoration of the Box Canyon Creek water diversion structure eroded in fall of 2016. With cooperation from CIRI for access to the project site, SBCFSA funded $9,000 to rebuild the 1,400 foot long gravel embankment that protects the Exit Glacier neighborhood. d. The service area currently has a request for quotes out to contractors for the restoration of the 1,200 foot long embankment on Salmon Creek, north of Clear Creek. This gravel berm, built during the 2012 flood event, diverts waters to the east, away from the confluence of Clear Creek. High water events these last few years have eroded the embankment and the awarded contractor will rebuild it to previous conditions before mid July. e. The service area has received a five-year land use permit from the Alaska State Department of Natural Resources (DNR) for channel and embankment maintenance on Sawmill Creek, upstream from the Nash Road Bridge. A project will go out for bid mid - June to push streambed material from the center of the creek to clear the channel and repair gravel berms breached last fall. The SBCFSA board has also begun work on a site specific mitigation plan for sediment management on Sawmill. Creek. Once a plan is approved by the DNR Commissioner, the service area would be able to maintain the upstream channel on a regular basis and would be the first in Alaska to utilize State statute 38.05.872 to mitigate excess bedload for flood control without State material fees. f. The City of Seward received a $50,000 grant from the KPB, funded by the SBCFSA board, to assist with the Coastal Erosion Rip Rap project completed by Hamilton Construction in 2016. This erosion control project on 400 feet of shoreline will protect the water front walkway, Branson Pavilion and Community Skate Park. g. Last April, in cooperation with the City Public Works department, the SBCFSA funded $4,250 to clean out a culvert under Second Avenue which caused flooding of the Two Lakes trailhead and threatened the neighboring property. SBCFSA will work with the City in fiscal year 2018 to replace this aging culvert. h. In 2015, the service area contracted with Alaska Map Company and worked with the KPB Geographic Information System team to correct the discrepancy between parcels and imagery on Lowell Point and the Seward Marine Industrial Center. Having correct parcel information assists with floodplain regulation, determining properties within a special flood hazard area, and the presentation of maps for public meetings. i. The Dairy Hill Drainage Improvement project was completed in 2014 with funding and resources from the City, $350,000 from the Hazard Mitigation Grant Program, and $176,000 from the service area. This site was severely damaged in the flood of 2009, and completion of the project alleviated the washout of roads, culverts and potential private property damages during heavy rainfalls. j. Long-time SBCFSA Chairman Bill Williamson recently resigned his seat on the service area board. His service to our community these last 15 years has been greatly appreciated and his leadership will be missed. Board seats D and F are now vacant. Interested residents of the service area can submit an application to the KPB annex office in Sea View Plaza and would be appointed until the election in October. In Washington State, most of these older coastal studies were drawn using only engineering judgement with no derived flood elevations, even in the city of 'Seattle. There are now 14 Washington counties that are being updated which include 136 communities in the countywide footprints, 18 tribes in the coastal footprint and 26 tribes impacted. overall. All 14 counties have newly derived coastal flood elevations from detailed Puget Sound coastal models. The process to get this information fully utilized in the community's regulatory framework requires a lot of coordination: ■ Meeting with the community and tribal staff to share draft maps and discussing community outreach for the preliminary maps, ■ Supporting community -led public meetings on the maps, Initiating a 90-day regulatory appeal period, resolving appeals and comments, and ■ Working with the communities to update their floodplain ordinances to reflect the new understanding of the risk. During these meetings, Region 10 has met with about 130 members of community and tribal staff at both the draft map and preliminary map stages. There have been 17 open house public meetings on these maps for 12 counties so far, including one ADCIRC Model for Puget Sound in Aberdeen in 2014. At these meetings, over 750 members of the public have attended. Five of these Washington counties have gone through their full regulatory process and their maps are considered "effective" maps. Another five will make it this year. These maps have allowed the Chehalis Tribe to move to being a full participant of the National Flood Insurance Program, the Hoh Tribe and the Quileute Tribe will follow by the end of this year and next year, respectively. While updating floodplain ordinances in Grays Harbor County, six communities chose to adopt at least nine standards that go beyond FEMA's minimum requirements including adding three feet of freeboard, ensuring no adverse impact to neighboring landowners, restricting hazardous materials from the floodplain, etc. The new studies lay the groundwork for establishing technical credibility with communities that FEMA can build on through the Risk MAP process to help communities take Continued on next page PdskMAP Increasing Resilience Together .JUKE 2017 www.starr-team.com NEWS FROM REGION 10 Washington Coastal (cunt.) mitigation action to reduce their exposure to natural hazards. These studies have helped greatly to build on relationships between FEMA Region 10 and Washington Department of Ecology, Department of Natural Resources (WA DNR), Sea Grant, Emergency Management Division, and others. One outcome of Risk MAP is a completed risk assessment for each community. FEMA has partnered with WA DNR as well as our national contractor STARR to create an inventory of structures in the Puget Sound and outer coast. This structure -specific data enables the use of Hazus to determine impacts from earthquakes and floods, as well as risk exposure for other hazards including tsunamis, landslides, and volcanoes. Combining this natural hazard data with the community's infrastructure and bringing in State partners who can offer their expertise and financial resources (grants) to mitigate risk initiates the Region 10 Risk MAP Resilience process. In addition to identifying mitigation actions, the risk assessment data can also be used for preparedness, response, and recovery at all levels of government. Five of the 14 coastal counties have started the Resilience process, including Pacific, Grays Harbor, Kitsap, Whatcom, and Pierce Counties. The Resilience meeting offers a significant opportunity to connect with State and Federal partners while advancing conversations on risk reduction activities. Kitsap County utilized this process to discuss their risk of a Seattle Fault Earthquake.
