RESOLUTION PROVIDING FOR AN EASEMENT ACROSS A
OF CITY-OWNED LAND TO SEWARD MARINE SERVICES,
S, the City of Seward, Alaska is owner of real
lly described as follows:
WHEREAS: several ars ago a portion of a building and
dock now owned by Seward Mar'ne Services, Inc. were erroneously
located on the land describe above; and
WHEREAS, the City Coun il hereby finds that it is in
the public interest for Seward rine Services, Inc. to
continue to operate its warehouse and dock on the land
described above due to the positiv effect which that
enterprise has on the economy of Se ard; and
WHEREAS, the City Council he eby finds that the
described land has not previously been dedicated to any public
use; and
WHEREAS, the City Council hereby finds that the
granting of an easement across the describ d land through
public sale is not in the public interest a d that the granting
of an easement across the described land by eans of
negotiation with Seward Marine Services, Inc. is in the public
interest:
NOW, THEREFORE, BY IT RESOLVED BY THE C TY COUNCIL OF
THE CITY OF SEWARD that

Section 1. The City Manager is hereby authorized and
to negotiate with Seward Marine Services, Inc. whereby
the Ci reserves the right to construct a sewer line under and
connect d to the Seward Marine Services, Inc. dock and grants
to Sewar Marine Services, Inc. an easement allowing it to
continue occupy and operate its warehouse and dock.
The City Manager is further authorized and
such easement on behalf of the City.
