RESOLUTION NO. 121
WHEREAS, on the 2nd July 1934, the City of Seward, Alaska conveyed a
certain tract of land (formerly a part of the Brownell Homestead) to ALICE
BRQiNELL, the deed for which was duly recorded in Volume 14 of Deeds at page
135 of the records of Seward Precinct; and
WP~EAS, on the 6th of November 1951 the City of Seward conveyed an add-
itional tract, adjoining the above-mentioned tract, to DON CARLOS BROVrnELL and
ALICE A. BROJNELL, which deed was thereafter recorded in Volume 15 of Deeds at
,I page 3ll on the same day; and

! -WHEREAS, on the 13th June 1952, the said DON CFRLOS BROVrnELL and ALICE A.
BRa^rnELL, husband and wife, entered into a real estate contract for the sale
of both tracts (as one unit) to Joseph B. and M. Elizabeth Deisher of Seward,
Alaska, which said contract is of record as of the 18th July 1952 in Volwme
19 Records p. 24; and

DiIS~ER and M. ELIZF~ETH DEISHRli: under and by virtue of said contract; and
vfrlBREAS, on an application for an F.H.A. Loan, the description of said
land was objected to by the Title Insurance and Trust Company of Alaska, as
defective, because the length of the line describing the southeastern boundary
of the tract described in Volume 14 Deeds 135 was not set forth in said deed.
NOW, TEEREFORE, For the purpose only of correcting the description of
said property:

That the Mayor and Municipal Clerk of the City of Seward, Alaska be and
they hereby are authorized to execute a QUIT CLAIM DEED, releasing, relinquish
ing and quitting the claim of the City of Seward, Alaska to the said Josqn
B. Deisher and M. Elizabeth Deisher to the identical land conveyed by the City
of Seward, Alaska to Don Carlos Brownell and/or Alice A. Brownell as aforesaid
but described in a manner setting forth more accurately the metes and bounds 0
said tract, and
BE IT FURTP~R RESOLVED that an emergency is delcared to exist and that
the rules governing the passage of Resolutions be and they are hereby sus-
pended and that this Resolution be given effect and it is hereby given effect
as of the date of its passage and approval.
