RESOLUTION 2002-082
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH TRYCK NYMAN HAYES, INCORPORATED (TNH)
TO PROVIDE PUBLIC INVOLVEMENT AND SCHEMATIC DESIGN
SERVICES FOR THE EAST HARBOR EXPANSION PROJECT FOR AN
AMOUNT NOT TO EXCEED $115,000
WHEREAS, the City of Seward has long pursued the expansion ofthe Small Boat
Harbor; and
WHEREAS, in 1998, the U. S. Army Corps of Engineers, Alaska District, (US ACE)
completed a Feasibility Study and an Environmental Assessment for the project; and
WHEREAS, the Feasibility Study was favorable and the project was approved in
FY1999; and
WHEREAS, the Project failed to gain federal funding until FY2002, when $1 million
was appropriated for design and construction; and
WHEREAS, the City sought, and received, $2.9 million in matching funds from the
State of Alaska, Department of Transportation and Public Facilities in 2000 and a $1.3 million
Department of Commerce, Economic Development Administration Grant in 2001; and
WHEREAS, the remainder of the federal funds, approximately $4.0 million, IS
earmarked for appropriation in FY2003; and
WHEREAS, the USACE is preparing contract specifications for project construction
beginning in the fall of2003 and since several components ofthe federal portion of the project
and the City's portion overlap, it is prudent to begin the public input and planning process for the
inner harbor development; and
WHEREAS, the initial stages of the inner harbor development consist of a
comprehensive Public Involvement Process leading to the schematic design, or layout, of the
proposed facilities; and
WHEREAS, TNH, at the City's request, has provided a proposal for these items and
services; and .
WHEREAS, per City of Seward Code of Ordinances S6.10.120, Engineering
Services are professional services and exempt from competitive procurement procedures.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into an agreement with Tryck
Nyman Hayes, Incorporated, for Public Involvement and Schematic Design Services for the
East Harbor Expansion Project in substantial form as attached hereto and incorporated by
reference for an amount not to exceed $115,000.
Section 2. $115,000 is hereby appropriated from the Alaska Railroad Corporation
Dredging Reimbursement Fund Retained Earnings, account number 276-0000-3071-0274 to
the Harbor Eastward Expansion Fund, account number 274-0000-3071-0.
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this
26th day of August 2002.
