RESOLUTION 2002-093
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AMENDMENTS TO THE GENERAL FUND LEGAL
BUDGET FOR THE CALENDAR YEAR ENDING DECEMBER 31,2002
AND APPROPRIATING FUNDS
WHEREAS, with the legal billings through August 20, 2002 (66.7% of CY2002), the
General Fund legal is at 97.9% of budget, the Parking Revenue Fund is at 0.0% of budget, SBH
Renovation Project is at 99.1 % of budget, the Small Boat Harbor Fund is at 14.6% of budget, the
SMIC Fund is at 6.1 % of budget, the Electric Fund is at 46.8% of budget and the Water/Sewer Fund
is at 0.0% of budget; and
WHEREAS, overall legal expenditures through August 20, 2002 total $155,122 and is at
67.4% of the CY2002 overall legal budget; and
WHEREAS, the year-to-date General Fund legal is over budget primarily due to the legal
costs associated with the long-term care facility; and
WHEREAS, the issues around the long-term care facility have required the involvement of
the City's law firm and in addition, the complexity of the lease and the health care issues required the
City through the City Attorney to contract with a law firm that specializes in health care; and
WHEREAS, through August 20,2002, approximately $36,026 has been spent on legal costs
related to the long-term care facility; and
WHEREAS, it is anticipated that there will be an additional $IO,OOO.in legal costs for the
remainder of the budget year.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The amount of $50,000 be appropriated from the General Fund fund balance,
account no. 101-0000-3050 to the General Fund Legal, account no. 101-1115-5170 for legal costs
related to the long-term care facility.
Section 2. This resolution shall take effect immediately upon its adoption.
