RESOLUTION 2002-107
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A USE AGREEMENT
FOR A PORTION OF THE NORTHEAST PARKING AREA WITH NORTH STAR
PAVING AND CONSTRUCTION INCORPORATED, FOR A PERIOD NOT TO
EXCEED 120 DAYS
WHEREAS, the State of Alaska Department of Transportation ("DOT") is performing
upgrade and maintenance on Port Avenue in Seward; and
WHEREAS, DOT has contracted with North Star Paving and Construction Incorporated
("North Star") to accomplish the work on Port A venue; and
WHEREAS, North Star has discovered contaminated soils under Port Avenue; and
WHEREAS, North Star requested the use of a portion of the City's northeast parking area for
a limited period oftime to store and treat the contaminated soil; and
WHEREAS, North Star agrees to be completely responsible and to release and indemnify the
City from any environmental release as a result of its use of the northeast parking area; and
WHEREAS, North Star has agreed to accomplish all of its decontamination efforts in
conjunction with a plan prepared for CH2MHILL dated October 14,2002; and
WHEREAS, the City desires to assist in accomplishing the above described work provided
that the City does not incur any liability or costs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into a Use Agreement with North Star, in
substantially the form as presented at this meeting, for a portion of the northeast parking area for a
period of not to exceed 120 days and otherwise in accordance with SCC 7.05.410.
Section 2. This Resolution shall take effect immediately upon its adoption, provided that the
Use Agreement is subject to suspension during the first 30 days after passage and posting of this
Resolution if a sufficient referendary petition is filed in accordance with Section 4.8 of the City's
Charter.
