CITY OF SEWARD, ALASKA
RESOLUTION 2002-108
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING AMENDMENT OF ITS
LEASE WITH THE UNIVERSITY OF ALASKA TO RELINQUISH
A CORNER OF THE LAND LOCATED AT RAILROAD AVENUE
AND LOWELL POINT ROAD FROM THE LEASED AREA
WHEREAS, the City of Seward and the University of Alaska entered into a long-
term lease dated July 1, 1970, recorded April 8, 1991 at Book 60, Page 776 in the records
of the Seward Recording District; and
WHEREAS, the University of Alaska recognizes the desire ofthe City of Seward
to dedicate a portion of the leased land to be used for pedestrian pathway access and to
allow construction of such by the State of Alaska Department of Transportation and
Public Facilities; and
WHEREAS, the University of Alaska has agreed to relinquish that comer of its
leased area consisting of approximately 527 square feet; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA that:
Section 1. The City Council authorizes the City Manager to execute and deliver
an amendment and partial release of Lessee's interest in substantially the form as attached
hereto, effectively amending the City's lease with the University of Alaska to delete a
portion ofthe property described as follows:
That portion of Tract IB, Waterfront Tracts Subdivision, Mariculture
Addition, according to Plat No. 97-18; records of the Seward Recording
District, Third Judicial District, State of Alaska, described as follows:
Beginning at the South West comer of said Tract IB, thence N 05014'46"
E a distance of 115.626 meters (379 :t feet) along the western property
boundary to the true point of beginning, thence continuing Northerly along
the property boundary a distance of 10.950 meters (36 :t feet), thence N
56030'44" E a distance of 11.394 meters (37 :t feet) along the property
boundary adjoining Railroad Avenue, thence S 31025'29" W a distance of
20.146 meters (66 :t feet) to the true point of beginning. Said parcel
containing 0.0049 hectares (527 :t Square Feet), more or less.

Section 2. This Resolution shall take effect immediately upon its adoption.
