HomeMy WebLinkAboutRes2002-113 I I I Sponsored by: Gifford CITY OF SEWARD, ALASKA RESOLUTION 2002-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO AN AGREEMENT WITH AFOGNAK CONSTRUCTION & EXCAVATING, INC. TO REMOVE ROCK FROM THE 4TH OF JULY CREEK ROCK QUARRY FOR THE ALASKA DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES PROJECTS ON THE KENAI PENINSULA WHEREAS, Afognak Construction & Excavating, Inc. (the "Contractor") has a contract with a third party to provide rock for projects on the Kenai Peninsula relating to recent flooding (the "Projects"); and WHEREAS, the Contractor estimates that the Projects will require less than 10,000 tons of rock; and WHEREAS, this amount of rock may be available, without the need for any further blasting, at the City's 4th of July Creek Rock Quarry ("Quarry"); and WHEREAS, the Contractor has requested a contract with the City of Seward to remove rock from the Quarry for the Projects; and WHEREAS, the City's Director of Public Works recommends a price of not less than $15.00/ton for rock removed from the Quarry which will provide revenue to the City of Seward General Fund; and WHEREAS, the Contractor will measure the amount of rock removed from the Quarry by weighing each truckload of rock; and WHEREAS, this will be a non-exclusive contract at fair market value for a term to end December 31,2002; and WHEREAS, in accordance with Section 6.10.310 of the City Code the City Council may determine that competitive bids are not in the public interest. CITY OF SEWARD, ALASKA RESOLUTION 2002-113 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to negotiate and enter into a contract with Afognak Construction & Excavating, Inc. for the removal of rock from the City's 4th of July Creek Quarry at a price of not less than $15.00/ton as measured on a scale to be used by the Contractor for weighing each truckload of rock removed from the Quarry. The form of the contract will be in substantially the form as presented at this meeting. Section 2. The City Council finds that competitive bids or proposals are not necessary or in the public interest under these circumstances due to, among other facts, that this will be a non- exclusive contract for the City to sell rock to Afognak Construction & Excavating, Inc. for use in fulfilling its obligations to a third party who has in turn contracted with the Alaska Department of Transportation and Public Facilities, and the price is at least fair market value. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska, this 4th day of November, 2002.
