HomeMy WebLinkAboutRes2002-115 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2002-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO AN AGREEMENT WITH COLASKA, INC. TO REMOVE ROCK FROM THE 4TH OF JULY CREEK ROCK QUARRY FOR THE ALASKA DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES PROJECTS ON THE KENAI PENINSULA WHEREAS, Colaska, Inc. (the "Contractor") has a contract with the State of Alaska, Department of Transportation and Public Facilities to provide rock for projects on the Kenai Peninsula relating to recent flooding (the "Projects"); and WHEREAS, the Contractor estimates that the Projects may require up to 20,000 tons of rock; and WHEREAS, this amount of rock may be available, without the need for any further blasting, at the City's 4th of July Creek Rock Quarry ("Quarry"); and WHEREAS, the Contractor has requested a contract with the City of Seward to remove rock from the Quarry for the Projects; and WHEREAS, the City's Director of Public Works recommends a price of not less than $22.00/ton for "A" rock and $16.00/ton for "B" rock, loaded into Contractor's trucks by the City, which will provide revenue to the City of Seward General Fund; and WHEREAS, the Contractor will measure the amount of rock removed from the Quarry by weighing each truckload of rock; and WHEREAS, this will be a non-exclusive contract at fair market value for a term to end December 31, 2002; and WHEREAS, the State of Alaska has declared an emergency situation as a result ofthe recent flooding on the Kenai Peninsula and has an immediate need for the City's rock; and WHEREAS, in accordance with Section 6.10.310 of the City Code the City Council may determine that competitive bids are not in the public interest; and WHEREAS, Public Works has estimated that it would need an additional $15,000 in their CY2002 budget to cover the extra costs of working the "waste" pile. CITY OF SEWARD, ALASKA RESOLUTION 2002-115 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to negotiate and enter into a contract with Colaska, Inc. for the removal of rock from the City's 4th of July Creek Quarry at a price of not less than $22.00/ton for "A" rock and $16.00/ton for "B" rock, as measured on a scale to be used by the Contractor for weighing each truckload of rock removed from the Quarry. The form of the contract will be in substantially the form as presented at this meeting. Section 2. The City Council finds that competitive bids or proposals are not necessary or in the public interest under these circumstances due to, among other facts, that this will be a non- exclusive contract for the City to sell rock directly to Co laska, Inc. for use in fulfilling its obligations to the Alaska Department of Transportation and Public Facilities, and the price is at least fair market value. Section 3. The recitals stated above are incorporated herein by reference. The City Council finds that the state of emergency currently existing on the Kenai Peninsula requires immediate action. Section 4. Funds in the amount of $15,000 are hereby appropriated from the General Fund Gravel Sales, account no. 101-0000-4690-0400 to the Public Works Department, account no. 101-1310-5390. Section 5. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska, this 8th day of November, 2002.
