RESOLUTION 2002-121
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE CY2002 GENERAL FUND LEGAL BUDGET
BY APPROPRIATING $55,000 FROM THE GENERAL FUND FUND
BALANCE FOR GENERAL FUND LEGAL COSTS FOR NOVEMBER, 2002
AND THE ESTIMATED LEGAL COSTS FOR DECEMBER, 2002
WHEREAS, with the billings through November 20, 2002 (91.7% ofCY 2002), the General
Fund legal is at 119.9% of budget, the Parking Revenue fund is at 0.0% of budget, the Small Boat
Harbor Renovation Project Fund is at 99.1 % of budget, the Small Boat Harbor Fund is at 39.1 % of
budget, the SMIC Fund is at 7.0% of budget, the Electric Fund is at 49.6% of budget and the
Water/Sewer Fund is at 0.0% of budget; and
WHEREAS, overall, legal expenditures through November 20,2002 total $255,896 and is at
91.4% of the CY 2002 overall legal budget; and
WHEREAS, the year-to-date General Fund legal is over budget primarily due to the legal
costs associated with the long-term care facility; and
WHEREAS, the issues around the long-term care facility have required the involvement of
the City's law firm and in addition, the complexity ofthe lease and the health care issues required the
City through the City Attorney to contract with a law firm that specializes in health care and to
contract with a health care consultant; and
WHEREAS, through November 20,2002, approximately $68,370 has been spent on legal
costs related to the long-term care facility; and
WHEREAS, it is estimated that there will be $21,000 in legal costs related to the long-term
care facility and the hospital agreement that is not included in the budget and another $34,000 in
other General Fund legal costs to cover the current November legal billing and the anticipated
December legal costs.
NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The amount of $55,000 be appropriated from the General Fund fund balance,
account no. 101-0000-3050 to the General Fund Legal, account no. 101-1115-5170 for General Fund
legal costs for November, 2002 and the estimated legal costs for December, 2002.
Section 2. This resolution shall take effect immediately upon its adoption.
