HomeMy WebLinkAboutRes2002-123 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2002-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH TRYCK NYMAN HAYES, INCORPORATED (TNH) FOR REVIEW AND UPDATE OF THE CITY OF SEWARD'S SPILL PREVENTION, CONTROL AND COUNTERMEASURES PLANS FOR AN AMOUNT NOT TO EXCEED $18,950 AND APPROPRIATE FUNDS WHEREAS, the Environmental Protection Agency (EP A) requires facilities with bulk storage to maintain Spill Prevention, Control and Countermeasures Plans (SPCCs); and WHEREAS, an EP A visit in early 2001 noted the City of Seward's deficiency in SPCC plan preparation and required submittal of these plans; and WHEREAS, In accordance with 40 CFR 112.5(b), a review and evaluation ofthese SPCC Plans is conducted at least once every three years; and WHEREAS, in 2002, the EP A revised the SPCC program requirements and all SPCC plans on file with the EPA must be updated by February 1, 2003; and WHEREAS, these plans are site specific and require review and update by a licensed professional engineer and are typically generated by third party entities; and WHEREAS, TNH, at the City's request, has provided a proposal to review the five SPCC plans currently on file with the EP A, conduct site visits to assist in plan revisions and update and prepare SPCC plans that comply with the EP A requirements; and WHEREAS, per City of Seward Code of Ordinances S6.1 0.120, Engineering Services are professional services and exempt from competitive procurement procedures. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to enter into an agreement with Tryck Nyman Hayes, Incorporated, for review and update ofthe City of Seward' s Spill Prevention, Control and Countermeasures plans in substantial form as attached hereto and incorporated by reference for an amount not to exceed $18,950. Section 2. $18,950 for the work will be funded from existing operating budgets for the current fiscal year, placed into a Special Revenue Fund to carry over to FY2003 as follows: $11,370 from the Electric Enterprise Fund 501-5400-5390 (501-0-3070-0306), $3790 from the Harbor Enterprise Fund 401-4360-5390 (401-0-3070-0306),and $3790 from the SMIC Enterprise Fund 417-4500-5390 (417-0-3070-0306), and transferred and appropriated to the Oil Spill Prevention Fund 306-3060-5390. Section 3. This resolution shall take effect immediately upon adoption. PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska, this 18th day of December 2002.
