RESOLUTION 2002-141
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AN AMENDMENT TO THE OPERATIONS CONTRACT
WITH THE ALASKA DEPARTMENT OF FISH AND GAME FOR THE CITY OF
SEWARD TO OPERATE THE SEWARD MARlCULTURE RESEARCH CENTER AND
SHELLFISH HATCHERY, AND AMENDING THE AGREEMENT TO ASSIGN THE
OPERATIONS CONTRACT BY THE CITY OF SEWARD TO QUTEKCAK NATIVE
TRIBE
WHEREAS, the City of Seward and the Alaska Department ofFish & Game entered into Contract
No. IHP-98-028 in December 1997; and
WHEREAS, the City of Seward simultaneously entered into an agreement entitled, "Assignment of
Alaska Department ofFish and Game Agreement with the City of Seward to Qutekcak Native Tribe
for the Operation and Maintenance of the Seward Mariculture Research Center and Shellfish
Hatchery" (the "Assignment Agreement"); and
WHEREAS, Contract No. IHP-98-028 and the Assignment Agreement will expire by their terms at
the end of December 2002; and
WHEREAS, the parties desire to extend the existing agreements for one year to allow negotiations
to continue between the parties for ongoing lease and operations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council authorizes the City Manager to execute and deliver amendments
to Contract No. IHP-98-028 and the Assignment Agreement in substantially the form as attached
hereto.
Section 2. This Resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska this 9th day
of December, 2002.
