RESOLUTION 2002-026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO INCREASE THE
FUNDING FOR WM. J. NELSON & ASSOCIATES BY $13,000 TO ALLOW
THE COMPLETION OF THE ENVIRONMENTAL ASSESSMENT FOR THE
NORTH FOREST ACRES ACCESS ROAD/LEVEE PROJECT
WHEREAS, for the last several years, the City of Seward has worked toward a solution to
the flooding problems in North Forest Acres and the lowlands to the South of that area; and
WHEREAS, the City, with the assistance ofthe funding agency NRCS, has completed the
levee along Japanese Creek and has been attempting to obtain permits to complete the project by
extending the levee from the intersection of the Japanese Creek Levee with Diamond Blvd., to the
Seward Highway; and
WHEREAS, the City is working with the appropriate agencies who must agree with the
project in order for construction to proceed; and
WHEREAS, in order for the agencies to approve the project, an Environmental Assessment
(EA) must be prepared which discusses all of the issues and presents solutions which satisfy the
State and Federal requirements as well as addresses concerns of local citizens and the City of
Seward; and
WHEREAS, the City of Seward has engaged the services of an Engineer who has hired a
subcontractor, HDR Associates, to do the actual EA and, through no fault of their own that
contractor has expended more time on the project than originally anticipated, thereby causing the
price for preparing the EA to increase; and
WHEREAS, the Engineer hired by the City, Wm. J. Nelson & Associates, is requesting an
increase in their contract of $13,000 to cover the additional expenses of HDR Associates in
preparing the EA.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1 The City Manager is authorized to increase the contract with Wm J. Nelson &
Associates by $13,000 to cover the additional expenses ofHDR to prepare the EA for the North
Forest Acres Access Road/Levee project, including the 10% "mark-up" by the engineer for his
subcontractor.

Section 2. Funding for this project is to be from NRCS Flood Mitigation Project Account
666-6660-5390.
Section 3. This Resolution to take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 25th
day of March, 2002.
