RESOLUTION 2001-040
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE COMPLETION OF THE FORECLOSURE
PROCESS AND OBTAINING A CLERK'S DEED FOR THE JESSE LEE
HOME PROPERTY AND APPROPRIATING $50,000 TO SECURE THE
PROPERTY
WHEREAS, in 1995 the City of Seward filed a foreclosure action on the Jesse Lee Home
property (Lots 15A and 15B, Jesse Lee Heights Subdivision Addition No.4) for unpaid assessments
and associated penalties and interest Following that, the City and the property owner entered into
an agreement that would have discharged the property assessments if restoration and redevelopment
of the historic structures on the property were completed. That agreement expired on September 30,
2000, the restoration and redevelopment of the Jesse Lee Home has not been accomplished, and the
City is now in a position to complete the foreclosure process and obtain the property; and
WHEREAS, the Kenai Peninsula Borough has also initiated foreclosure on the Jesse Lee
Home property for delinquent property taxes; and
WHEREAS, the State Legislature has introduced a bill which would enable the State to
acquire the Jesse Lee Home property, and manage it in a way that recognizes its contribution to the
State's history; and
WHEREAS, the Seward Historic Preservation Plan recommends that the City continue to
monitor the status of the Jesse Lee Home and support efforts to save it, and the City Strategic Plan
encourages the recognition, rehabilitation and preservation of historic sites and buildings; and
WHEREAS, the Seward Planning and Zoning Commission recommends that the City Council
complete the foreclosure process and obtain a Clerk's Deed for the Jesse Lee Home property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section L The city manager and city attorney are authorized to take all reasonable steps
necessary to complete the foreclosure process and obtain a Clerk's Deed for the Jesse Lee Home
property which includes Lots 15A and 15B, Jesse Lee Heights Subdivision Addition No.4.
Section 2. Appropriates $50,000 from the Exxon Oil Spill Litigation funds, account no. 101-
0000-4630 to the General Fund, General Services division, Miscellaneous expense, account no. 101-
1180-5790 to secure the property from potential liability risks and to pay the costs of publication, title
report and other costs as may be necessary to complete the foreclosure process.

Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 19th
day of March, 2001.
