RESOLUTION 2001-043
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING CHANGE ORDER NUMBER 5 TO TRYCKNYMAN
HAYES INCORPORATED'S (TNH) ENGINEERING SERVICES
CONTRACT FOR ADDITIONAL CONTRACTING AND BIDDING
SERVICES FOR TWO FISH CLEANING STATIONS FOR AN AMOUNT
NOT TO EXCEED $19,395.
WHEREAS, on September 6, 2000, the Port and Commerce Advisory Board (P ACAB)
considered an administration proposal to sell a revenue bond to fund E float replacement during the
scheduled Small Boat Harbor Repair and Renovation Capital Project; and
WHEREAS, recognizing the needs of smaller businesses, the P ACAB recommended to City
Council a bond of $3 million to replace E float and build two fish cleaning stations; and
WHEREAS, on September 11,2000, the City Council passed Resolution 2000-094
authorizing the sale of a $3 million bond to fund replacement of E float and to build two fish
cleaning stations; and
WHEREAS, TNH provided a proposal to add to the existing engineering service contract
for the Small Boat Harbor Repair and Renovation Capital Project (approved by the City Council
in Resolution 99-143) for design of these fish cleaning stations; and
WHEREAS, Swalling Construction Company purchased the materials (Resolution 2001-
035) and will drive the piling for both stations (Resolution 2001-037); and
WHEREAS, negotiations with the contractor failed to reach an agreeable price for
construction of the stations and the remaining work will be bid separately; and
WHEREAS, TNH has provided a cost estimate for additional contracting and bidding
services; and
WHEREAS, this proposal would be added as additional services under Task #6 to the
current contract for an amount not to exceed $19,395; and
WHEREAS, under SCC 6.1O.120(A)(8), the purchase of professional services, such as
engineering services, is exempt from the competitive procurement procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. The City Manager is authorized to issue Change Order Number 5 to the
existing contract with Tryck Nyman Hayes, Incorporated, and issue appropriate Notice(s) to
Proceed for additional contracting and bidding services for two fish cleaning stations in
accordance with the attached proposal.
Section 2. The amount of this change order is not to exceed $19,395.
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 27th
day of March 2001.
