HomeMy WebLinkAboutRes2001-050 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2001-050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A LEASE AGREEMENT WITH DALE & CAROL LINDSEY TO LEASE 1706 SQUARE FEET OF OFFICE SPACE IN THE PETRO PLAZA BUILDING FORA PERIOD OF TWO YEARS AT A RATE NOT-TO-EXCEED $1.85/SF WITH AN OPTION TO EXTEND FOR TWO YEARS AT RATES TO BE NEGOTIATED FOR THE COMMUNITY DEVELOPMENT OFFICE AND THE ENGINEERING, BUILDING, AND ELECTRICAL DEPARTMENTS. WHEREAS, the Community Development Office and the Engineering, Building, and Electrical (Administration) Departments have been leasing space in the Ray Building for approximately 19 years; and WHEREAS, the Ray Building has deteriorated to the point where it is not suitable for office space; and WHEREAS, it is important to locate these departments in close proximity to each other due to the nature of the business they conduct with the public and the desire of the City of Seward to streamline the permit/code interpretation/zoning compliance process; and WHEREAS, an RFP was issued in March of2001 for space to house the aforementioned departments and three responses were received; and WHEREAS, the lowest cost responder with space suitable for use by the City of Seward Community Development Office and the Engineering, Building, and Electrical Departments was Petro Plaza located at 234 4th Avenue who submitted a proposal to lease 1,706 square feet of modem office space at a price of$1.85/sfincluding heat, electricity, water, sewer and two off-street parking spaces; and WHEREAS, the proposal from Petro Plaza includes an enclosed air conditioning and heating system, heated sidewalks, back-up electrical generation, and is ADA accessible; and WHEREAS, the annual operating costs for the four departments will be approximately the same and can be absorbed by the departments in the existing CY 2001 budget; and WHEREAS, approximately $38,000 ($34,700 est. plus contingency of $3,300) will be required by the four departments to pay moving costs such as phone lines, signs, and furniture requirements. CITY OF SEWARD, ALASKA RESOLUTION 2001-050 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Council hereby finds that, for the reasons stated in the above recitals, acquiring City office space by lease under the terms and conditions in the attached Lease Agreement is in the public interest. Section 2. The Lease Agreement between Dale & Carol Lindsey and the City is hereby approved in substantial form as attached hereto and the City Manager is authorized to sign the Lease Agreement in substantial form on behalf of the City of Seward. Any options to extend may be extended by the City Manager without further approval provided the lease rate and terms are substantially the same as the original lease and funds are annually appropriated. Section 3. The Lease Agreement is subject to annual appropriations of the City Council per Seward City Code Section 5.01.015. Section 4. An amount not-to-exceed $21,660 ($38,000 total cost x 57%) is hereby appropriated from the General Fund Fund Balance account no.101-0000-3050 as follows: $5,434 to the Building Inspection contracted services account No. 101-1350-5390; $8,132 to the Engineering contracted services account no. 101-1230-5390; and $8,094 to the Community services account no. 101-1150-5390. Section 5. An amount not-to-exceed $16,340 ($38,000 total cost X 43%) is hereby appropriated from the Electric Enterprise Fund Retained Earnings account no. 501-0000-3050 to the Admin. Electric contracted services account no. 501-5410-5390. Section 6. This Resolution to take effect thirty (30) days after its adoption and posting.
