RESOLUTION 2001-067
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, DETERMINING THAT IT IS IN THE PUBLIC INTEREST TO
WAIVE THE NORMAL BID PROCESS PER CITY OF SEWARD CODE
~6.10.130 AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A
LEASE AGREEMENT WITH XEROX FOR A REPLACEMENT COPIER
FOR THE HARBOR DEPARTMENT.
WHEREAS, the Harbor Department's photocopier contract is within two months of
expiration; and
WHEREAS, at the end of the lease period, maintenance calls will be billed at $280 per call,
plus time and materials and labor charges are billed at $60 per quarter hour; and
WHEREAS, the City's experience with heavily used copiers is maintenance, downtime and
delays increase with age; and
WHEREAS, over the last year, service calls have averaged one every two months and 30
minutes in duration; the charge for these service calls after the lease expires would be at least $400, or
an average of $200 per month, plus materials; and
WHEREAS, XEROX, the City's supplier for copiers, has made a proposal to replace and
upgrade the copier at the harbor with a digital machine with fewer moving parts and better quality
copies; and
WHEREAS, the lease is for sixty (60) months and includes the required non-appropriation
clause which allows the City to terminate the lease if monies are not appropriated for any given
budget year; and
WHEREAS, the rate quoted for a monthly lease from XEROX is $292.18 (approximately
$17,531 for the duration of the lease), with no rental payments until October 2001; and
WHEREAS, monies for this new lease is included in the current department budget and no
new appropriation is required; and
WHEREAS, it is in the public interest to waive the normal bidding process per City of
Seward Code ~6. 10. 130 because the current copier has a higher trade-in value with XEROX, Xerox
removes the copiers at no extra cost, and the maintenance support from XEROX is excellent owing
to their Kenai Peninsula location and the large number of Xerox copiers in Seward.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It is in the public interest to waive the normal bid process per City of
Seward Code ~6.1O.130.
Section 2. The City Manager is authorized to enter into a lease agreement with
XEROX for a replacement copier for the Harbor Department for an amount not to exceed
$17,531 for life of the contract
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 29th
day of May, 2001.
