<br />I <br /> <br />I <br /> <br />I <br /> <br />Sponsored by: Janke <br /> <br />CITY OF SEWARD, ALASKA <br />RESOLUTION 2001-075 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, <br />ALASKA, AUTHORIZING THE ACQUISITION BY DONATION OF LOT <br />5, FOLZ SUBDIVISION FOR THE EXPANSION OF THE CITY <br />ELECTRICAL FACILITY LOCATED ON ADJACENT LOT 6A, FOLZ <br />SUBDIVISION <br /> <br />WHEREAS, Alberta Hoseth, Personal Representative for Olga Midby Estate, has offered <br />to donate Lot 5, Folz Subdivision to the City of Seward; and <br /> <br />WHEREAS, Lot 5, Folz Subdivision is adjacent to the City's electrical storage facility and <br />future substation site on Lot 6A, Folz Subdivision; and <br /> <br />WHEREAS, the City of Seward, Manager of Engineering and Utilities has examined the <br />property, and recommends that the City accept the proposed donation of real property for the future <br />expansion of the electrical facility; and <br /> <br />WHEREAS, in accordance with SCC 7.05.125, a public hearing was held on the acquisition <br />of Lot 5, Folz Subdivision on June 25,2001. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SEWARD, ALASKA, that: <br /> <br />Section 1. The City Council finds that it is in the public interest to acquire by donation Lot <br />5, FoIz Subdivision for the future expansion ofthe City's electrical facility located on the adjacent Lot <br />6A, Folz Subdivision. <br /> <br />Section 2. The City Council further finds that the essential terms and conditions identified <br />in the May 23, 2001 letter signed by Alberta Hoseth, Personal Representative for Olga Midby and <br />attached as Exhibit A are in the public interest. <br /> <br />Section 3. The City Manager is hereby authorized to finalize the acquisition by donation, and <br />accept a Warranty Deed for Lot 5, Folz Subdivision, in accordance with the terms and conditions <br />identified in Exhibit A. <br /> <br />Section 4. This resolution shall take effect thirty (30) days after its adoption. <br /> <br />PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this day 25th <br />of June, 2001. <br />
