HomeMy WebLinkAboutRes2001-083 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2001-083 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING COMMENT ON THE ISSUANCE OF A PERMIT, U. S. ARMY CORPS OF ENGINEERS REFERENCE NUMBER 2-2001-0504, FOR CERTAIN WORKS IN TIDELANDS ADJACENT TO THE SEWARD SMALL BOAT HARBOR WHEREAS, the U.S. Army Corps of Engineers recently received a permit application for certain work in tidelands involving property adjacent to the Seward Small Boat Harbor and a public comment period is now open; and, WHEREAS, this work includes sheet piling and dredging tidelands in and adjacent to the harbor basin for the purposes of constructing a private use floating dock; and, WHEREAS, the tidelands and adjacent property are owned by the Alaska Railroad Corporation (Railroad); and, WHEREAS, the Railroad seeks to lease this land for development and the permit at issue relates to development of the Railroad's tidelands by its Lessee; and, WHEREAS, the City owns the submerged lands, all other tidelands in the Harbor, and the Harbor facilities and operates the Harbor as a public facility, and, therefore, the City has an interest in maintaining public navigation in the Harbor and promoting public use of the Harbor; and, WHEREAS, the State of Alaska required, with the transfer of the Harbor facilities and deferred maintenance funds to the City, that the City operate and administer the Harbor facilities as a public facility forever and for the benefit of the public; and, WHEREAS, City Charter 4,10 provides: "The council shall regulate the use and development of all waters and submerged lands which are subject to the jurisdiction of the city"; and, WHEREAS, certain Harbor management activities may be impacted including refusal of moorage, conformance to requirements for the use of the Harbor facilities, and the authority to regulate and control all boats in the basin; and, WHEREAS, plans to upgrade that portion of the harbor floats will have to be restricted or limited and the location of the dock may interfere with long-term plans for development ofthat corner of the harbor and require alteration of float arrangement, resulting in less effective layout and reduction in a number of future slips, CITY OF SEWARD, ALASKA RESOLUTION 2001-083 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section L The City of Seward objects to the issuance of a permit for certain work involving tidelands adjacent to the Seward Small Boat Harbor for the reasons stated in the recitals hereof, which are incorporated herein by reference. Section 2. The City Manager is hereby directed and authorized to deliver this Resolution, and any additional related materials to the permitting agencies and to provide such additional comment in writing on behalf of the City which relate to the impact to the City and public interest of such work and development in and adjacent to the Small Boat Harbor. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 25th day of June 2001.
