HomeMy WebLinkAboutRes2001-090 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2001-090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A LONG TERM LEASE AGREEMENT WITH SEWARD SHIP'S DRYDOCK INC. FOR PORTIONS OF THE UNSUBDIVIDED REMAINDER OF BLOCKS 7 AND 8, FOURTH OF JULY CREEK SUBDMSION, SEWARD MARINE INDUSTRIAL CENTER WHEREAS, Seward Ship's Drydock Inc. submitted a proposal on July 21, 2000 to lease additional land within the managed parcel of the Syncro-lift facility in the Seward Marine Industrial Center; and WHEREAS, Seward Ship's Drydocklnc. currently leases a 5.11 acre parcel described as Lot 1, Block 7, Fourth ofJuly Creek Subdivision, Seward Marine Industrial Center ("Current Lease"), and operates the Syncro-lift facility for the City under a Maintenance and Operating Agreement with the City; and WHEREAS, the requested lease property includes portions of the unsubdivided remainder of Blocks 7 and 8, Fourth of July Creek Subdivision, Seward Marine Industrial Center; and is generally described as a :1:2 acre parcel east of Sorrel Road which includes the northwest 180 foot dry berth rail, and a :1:1.5 acre parcel south of Sorrel Road which Seward Ship's Drydock currently uses for parking and storage; and WHEREAS, the requested property has been identified as available for lease in the Municipal Lands Management Plan and the Seward Marine Industrial Center Development Plan; and WHEREAS, pursuant to Seward City Code ~7.05.120, the City Council may dispose of interests in real property by negotiation, public auction or sealed bid; and WHEREAS, in accordance with the City's Lease Policies and Procedures, the Planning and Zoning Commission reviewed the proposal and adopted its Resolution 2000-04, recommending City Council approval of Seward Ship's Drydock request and further recommended that the City Council examine the original multi-user concept ofthe Syncro-lift facility, and consider leasing Seward Ship's Drydock additional lands within the managed parcel; and WHEREAS, this Resolution is not an acceptance ofthe terms ofthat proposal but authorizes the City Manager to negotiate a potential lease and agreement terms. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION 2001.090 Section 1. The City Council finds that it is in the public interest to negotiate and develop the terms of a lease of the real property described above to promote economic development in the City through expansion of industry and other commercial activities in the Seward Marine Industrial Center. It is also in the public interest to conduct negotiations with Seward Ship's Dry Dock, Inc. because of the lack of other potential users over the period such lands have been available for use in Seward. Section 2. The City Manager is authorized to negotiate on behalf of the City, a long-term lease with Seward Ship's Drydock, Inc. for portions of the unsubdivided remainder of Blocks 7 and 8, Fourth of July Creek Subdivision, Seward Marine Industrial Center; subject to consideration and final approval by the City Council at a later date. These negotiations may also include possible amendments to the Maintenance and Operating Agreement and the Current Lease, as may be necessary because of any impacts of a lease on those agreements. This resolution shall not be considered a contract nor final approval of a lease or real estate transaction. This Resolution is not an agreement to the proposal by Seward Ship's Dry Dock, Inc., or any of its terms, but merely an authorization to negotiate such terms. It is intended that the City Manager will negotiate the terms of the lease and any other agreements or matters related to this transaction for the City Council's subsequent consideration and approval pursuant to the provisions of Seward City Code Chapter 7.05 and all other applicable Seward City Charter and Code provisions. Any subsequent resolution to approve such an agreement or agreements will not take effect until 30 days after passage and posting as required by Seward City Code ~7.05.140. Section 3. This resolution shall take effect immediately. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 23rd day ofJuly,2001.
