RESOLUTION 2001-098
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO AMEND THE LEASE
AGREEMENT, LEASE NUMBER RE 85-045, WITH THE U. S.
DEPARTMENT OF THE INTERIOR, NATIONAL PARKS SERVICE,
KENAI FJORDS NATIONAL PARK (NPS), TO CHANGE THE EFFECTIVE
DATE OF RENTAL ADJUSTMENTS TO OCTOBER 1 IN THE YEAR OF
THE APPRAISAL.
WHEREAS, the City of Seward City Council approved a long-term lease with the NPS on
June 24, 1985 by Resolution 85-26; and
WHEREAS, this lease provided for appraisals at five year intervals and rental adjustments to
be effective on the anniversary date of the lease; and
WHEREAS, the NPS budget corresponds to the federal fiscal year, which begins on October
1 of each year; and
WHEREAS, the NPS has requested an adjustment to the effective date of future rental
adjustments to correspond to the federal fiscal year, October 1.
WHEREAS, the regular rent will continue to be adjusted at five year intervals to fair
market rental value.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It is in the public's interest to amend the lease agreement with the NPS for
this property.
Section 2. The City Manager is authorized to enter into a lease amendment with the
NPS for Lots 13 and 14, Block 6, Seward Small Boat Harbor Subdivision, attached and
incorporated herein by reference, in substantial form as attached hereto, to record a lease
memorandum to reflect amendment, and to make changes to the attached lease amendment
as necessary to finalize the amendment between parties but without changing the substantive
terms as described in the attached lease amendment
Section 3. This resolution shall take effect thirty (30) days after its adoption.
