HomeMy WebLinkAboutRes2001-165 I I I Sponsored by: Janke CITY OF SEWARD, ALASKA RESOLUTION 2001-165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE LEASE AMENDMENT NO.1 TO THE SEWARD CHAMBER OF COMMERCE LEASE AGREEMENT FOR THE PROPERTY LOCATED AT 2001 SEWARD HIGHWAY WHEREAS, the City of Seward leases Lot 4, Fort Raymond Subdivision to the Seward Chamber of Commerce at no cost for a visitor information center/office complex; and WHEREAS, the initial term of the lease was from September 27, 1989 through June 30, 2000; and WHEREAS, the lease agreement allows for two, five (5) year extensions of the lease subject to all terms and conditions of the lease being reviewed and mutually agreed upon prior to either extension taking effect; and further stipulates that by inaction of the parties, the Lease shall be deemed to continue from month to month; and WHEREAS, the lease requires that if the lease is extended beyond the initial term, a new lease rate shall be negotiated which takes into consideration the value of the land based upon the current zoning and land use designation; the public contribution of the Chamber operations to the community and site improvements made by Lessee; and WHEREAS, the Seward Chamber of Commerce has demonstrated its commitment to the residents, visitors and businesses of Seward by developing the property and continuing to promote economic development, tourism and community events; and WHEREAS, The existing use of the property by the Chamber of Commerce for a visitor information center on Lot 4, Fort Raymond Subdivision is compatible with the existing Institutional Land Use Plan and Zoning designation of the property; and WHEREAS, the City has no other plans, nor foresees a higher and better public use of Lot 4, Fort Raymond Subdivision. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The recitals are hereby incorporated by reference. The City Council finds that it is in the public interest to extend the Seward Chamber of Commerce Lease Agreement until June 30, 2005 as provided for in the lease agreement. CITY OF SEWARD, ALASKA RESOLUTION 2001-165 Section 2. The City Council further finds that it is in the public interest to continue the lease at no cost to the Chamber of Commerce so long as the site is used by Lessee for the operations of a Chamber of Commerce office/visitor information center. Section 3. Lease Amendment No. I to the Seward Chamber of Commerce Lease No. 89- 077, attached and incorporated herein by reference as Exhibit A, is hereby approved, and the City Manager is hereby authorized to execute the lease amendment on behalf of the City of Seward. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this lOth day of December, 2001.
